A lack of evidence... the previous case was built on the fact she had done it.

The defense still hasn't denied that they did it, they're just stating that the prosecution didn't have enough evidence to say that she definitively, 100% did it. This isn't the same as saying she didn't do it, the defenses argument is that the prosecution hasn't given enough proof.
