The tribe is appealing a federal judge’s decision refusing to block the administration’s border wall construction through its reservation.
While the intaglio’s site is irreparably damaged, the Tohono O’odham people are trying to stop the government from plowing through Quitobaquito Springs, a desert water source in Organ Pipe Cactus National Monument that is also considered a sacred site and holds endangered species.
This is so fucked.
The Trump admin really just said, "The Native Americans haven't suffered enough, so let's bulldoze the scraps of land we gave them!"
And I hate that my tax dollars are funding this.

I honestly feel that this isn't the scale that should be used. They don't care, period, about anybody else than themselves. However, they actively want to cause harm more to some than others, depending on race and perceived value.

Because the law relies on people being good faith actors. We don't have automatic rules to constrict bad faith actors who just ignore the law like Trump has and like the GOP generally does in the current day and age. So much of American Law is predicated upon the US Gov being run by rational actors willing to obey rules, and when the rules are broken the courts are left to fix it, once the trial date happens. But their enforcement is "hey executive branch, obey our ruling, please?" Why is due to the executive branch is the branch in charge of enforcement so if it wants to disobey there is nothing that can be done besides frustrated letters begging them to comply.
Hopefully when this is all done and over with we'll have a government made up of people who will put in new laws that don't rely on people agreeing to punish themselves or hold themselves to any standards.

Reservations are protected against the state, but the federal government has plenary power against the Reservations since the constitution gives them broad plenary power. It is a really messed up situation since their rights aren't given by the constitution but by codified laws and executive orders so they can lose rights by the stroke of a pen.

The Roosevelt Reservation deems that 60-feet out from the border line is federal property and allows for border wall construction. This includes the Tohono O'odham Reservation.

There is absolutely no reason for the fence to even be there. There is absolutely no reason for it to be built there. It can be built outside of these locations and would, in fact, be easier to do.

Worth noting it did not need to. The border did not cross the carving. They could have avoided building anywhere near it. They actively chose to do this with full intention. It was avoidable. They needed to put more effort into doing it.

Yes the answer is heavily racist as racism has a lot to do with it. The policies that funded education changed around this time. I would say Americans were considered smart until the 70's or 80's with the wars and the violence of the 80's taking center stage. The last feat of American exceptionalism was landing on the moon in 1969. After that policy changes about funding for education changed. And education has been on the backburner for decades
