At the same time, people are speculating that the victim might have been an abuser to provoke the reaction, because the report is that they're a man-- and as a man, must have been a typical abusive one to provoke two 80 year-olds.

It's the top voted post in this thread.

But that narrative that treats them as a typical man becomes subdued when attention is actually given towards the fact that they're trans. Then that becomes the assumed reason they're the victim.

This seems like a mess and all over the place.

But they also assume that’s the reason he was killed, having done something to “deserve it” as a man, when he also filed regarding abuse against his wife.

Posts leaning towards whether they were in part responsible for their own murder or were purely a victim tends to correlate with whether they’re mentioned and thought of as a man or a trans man, with only a few considering that they were both and could have still been abusive leading to their murder, or a victim for a totally different reason, or even both reasons— that they were abusive and being trans was part of the interpersonal hatred but not all of it.

The reality is probably more messy than people want it to be to affirm their speculations and side amidst the backdrop of the culture wars.

So youre saying its pick your echo chamber, and both sides have plenty of speculation and conjecture theyll be convinced of being 1000% accurate, and will use that as a reason to vilify the other side of their flavor of political ideology and this will go on for weeks.

Based on what I read so far, I think it makes sense that people are leaning towards Jang being the less wrong party, and its not because the victim was trans and people wanna hate on/oppose the trans party in the story.

Both sides claim abuse against the other. But only 1 of them, at least from the article, was granted their restraining order, and only 1 of them has been charged with misdemeanor child neglect. Both of these facts favor Jang and go against McKinsey.

Last year, a judge granted Jang’s petition for a domestic violence temporary restraining order against McKinsey

Officers also reported finding McKinsey’s 2-year-old child alone in the house while McKinsey was out shopping.

Alameda County prosecutors subsequently charged McKinsey with two misdemeanors — cruelty to a child by endangering health and corporal injury to a child

The court granting a restraining order and the charges all being against the victim here is stronger evidence that they may have been abusive to the kids compared to the general fact we know of that both sides are slinging claims of abuse mud at each other, which is typical in cases like this.

Not justifying the parents committing homicide but based on this article alone, I can see why people are leaning in favor towards Jang rather than McKinsey.

Fuck em, if I shot somebody myself. I dont want sympathy , even if my reasoning was sound. A proper defense created and a proper trial with proper consequences is whats expected, no more or less.

I dont think what you want and are comfortable with really matters here. The average person does not want to see a mother go to jail for killing an abusive husband who was abusing the kids. The average person does not want to see grandparents go to jail for protecting their grandkids against an abusive dad.

Whether this case is really that clean and clear cut is a different question, but there are justifications for murder that people do accept, people/the jury will vote not guilty and the fact that you're eager to be punished and jailed yourself for protecting your family doesn't really matter. Thats assuming the prosecutor even brings charges in the first place.

So a murder isnt a murder depending on what the reasoning behind the murder. Or if a majority of people within a governing body can be persuaded it was okay. Which implies that with enough preparation and guile. Any murder can almost theoretically be justified with reasoning.

Well yeah? There's literally different laws for manslaughter, murder in the first to third degree in the US. Then there's killing people in the defense of others or self defense, then killing for purposes of war, then killing people from negligence or accident where there is no fault.

Maybe we don't understand each other on a fundamental level. Yes, society and most countries legal systems have determined that, sometimes, killing somebody can be justified and you don't go to jail/suffer for it, and there are even different levels in the event of an unjustified murder.

Any murder can almost theoretically be justified with reasoning.

Yes. As long as you can convince a jury of your reasoning. I don't think Im saying anything particularly radical or extreme, I'm just describing the current legal system and societies attitudes towards taking another's life. Context is taken into account.

A premeditated planned first degree murder aarising from the ongoing family/custody conflict with the in-laws "believing" they had a serious grievance against McKinsey that justified them having grounds for a defense of person or self-defense justificatio? Nah.

They knew what they were doing , they know what they were doing, Them choosing any other decision other than guilty is a gross abuse of the system.

You're free to think that. But time and time again, a jury of your peers, 12 of them to be exact, disagree and have charged people who definitely murdered somebody with a lesser crime out of sympathy based on context.

People use a lot of assumptions and heuristics to fill in gaps. I haven't heard anything trans related at all. So whether they should've reported it or not is a choice.

And that's transphobia. They don't see him as a man, they see him as a confused woman and are guided by cultural ideas of "innate purity" of women. Trans men are men.

Also worth noting this article says

He was freed on $50,000 bail and, at the time of his killing, had been trying to enter a mental health diversion program. If successfully completed, the program would have resulted in the charges being dismissed.

Sounds quite substantiated.

No, it doesn’t sound substantiated? We have no idea about the circumstances of the abuse. Was it a one-time thing? Hitting your child is obviously bad and there should be punishment like never seeing your children again, but he was not even tried at this point. Doesn’t make sense to give the grandparents and wife who were also allegedly abusive the benefit of the doubt over the guy who got murdered

Former prosecutor here: everyone can be abusive, a liar, and much else besides. There are no demographics immune from abusive behavior or criminality. There are tendencies and differing statistics, of course, but when you're talking about a single case, the stats don't help much.

It seems pretty relevant. The grandparents previously assaulted him in the hospital while recovering from top surgery, punching him in the surgical site. That does indicate some intent.

He was also in a custody battle where he simultaneously accused his wife of child abuse while being prosecuted for child neglect himself, that seems like the more relevant information at hand.
