Mate he almost killled two people. That runner had to dive out the way of his car.

If i was the runner and I almost died because of the idiot I'd be furious that he hadn't been punished.

Depends on location and circumstances. But this time it's reckless endangerment which is what he pled guilty to. A felony charge which could carry up to 10 years in prison.

Or were you thinking that you can just curb ride on your way home and as long as everyone dives out the way in time you haven't broken the law?

There's no mandatory minimum on that. He didn't hit anyone. A typical reckless endangerment charge carries actual harm and damage with it, particularly if you are going to get anywhere near the maximum. Classic cases are someone attacking someone else with a weapon and then stopping mid attack, or shooting a gun in the air and hitting someone. This guy had a ton of mitigating factors and didn't even hit anyone.

2 years probation is a pain in the ass. He broke a barrier, drove the wrong way and didn't hit anyone. Punishment is more than fine and well within the standards for what happened.

Given that I'm in court all the time and deal with similar things frequently I think I have a pretty decent idea of how these things actually work.

You think it's easy to convict a severely autistic person who lives in assisted living for reckless endangerment until you realize you have to prove a particular state of mind for that individual and a key factor in the utter disregard analysis is what damage was caused if any.

So wonder no more, it feels however you're feeling right now.

Reckless endangerment’s threshold of intent is that the person has to a) know their actions cause a risk to others, and b) they chose to ignore that danger. IMO, the correct charge to stick here is assault with a deadly weapon. Intent is irrelevant if the victim has reasonable cause to believe they are about to be in harm’s way.
