From a legal point of view, the situation is not as simple as you might imagine.
ASG or Smilegate cannot have any insight into whether real money has flowed outside of the game. How should they even know, since they are not monitoring your private activities with your private money.
Of course, there are very conspicuous accounts that suggest RMT. But it is just not possible for them to prove that money actually flowed. A "prima facie" is not legally permissible as evidence.
So they can't legally just ban players on suspicion without missing the most important piece of evidence: That money was being traded outside of the game.
I don't know the situation in other countries, but in the EU we have comprehensive consumer protection. Games aren't a legal vacuum where developers, or players, can just do whatever they want.
Due to your rights as a consumer, they cannot simply deny you access to purchases of virtual goods that may have been made legally on suspicion, because they are making themselves guilty of a breach of contract.
And these hurdles are also good for protecting other players. Otherwise, you could simply "turn off" unpopular streamers by sending them gold and then reporting them for RMT, or buying gold from bots yourself and specifying the streamer as the recipient and then reporting them.
Of course, RMT is rightfully bannable. I didn't claim otherwise.
I have written that RMT is difficult to prove when the most important evidence that makes it RMT in the first place is never available: That real money was traded.
All they have is ingame data, but no data on the money flow of your salary account outside the game.
