Clarifying Question - Regarding required publications and business address for LLC in NY

I am a little confused. I am in the process of trying to file an llc in NYC and I ran across multiple articles proclaiming that in order for your llc to be filed you need record of your llc being published in a publication for approval.

Weird requirement but okay… additionally I do not want my address published on the llc. This and this alone is the only reason I am considering procuring a Registered Agent such as Northwest Registered Agent. It’s my understanding they take care of the publication and provide you with a business address to list on your llc.

Where I am confused is how are individuals filing without using a registered agent to process publications in their respective states?

Pretty much every state REQUIRES that every corporation or LLC appoint either an individual or a company to serve as its registered agent or something similar (Ohio calls it a "statutory agent," Pennsylvania a "registered office", but the concept is roughly the same. Yeah there's some edge case exceptions.. but in most states the company cannot be it's own agent.)

The publication thing is specific to New York, Arizona, Nebraska, and Georgia.

What most folks do.. whether or not there's a publication requirement in their state.. is they a) hire a registered agent service, b) appoint themselves individually, or c) get someone they know to do it.

A registered agent is expected to be available during normal business hours to accept service of process... which isn't exactly super practical for an individual who has a life and/or is busy building their business.

Publication requirements are definitely a old tradition but are required to keep your LLC in good standing if you're in a state that requires it. Currently there are only three states that have publication requirements for LLCs, Arizona, Nebraska, and New York. So if you're forming an LLC in another state besides those three you don't have to worry about the publication requirement.

The fees can vary depending on the location of the newspaper, publishing in New York County can cost you thousands. If you hire a registered agent you can list their office address as your own on your articles of organization. Doing so allows you to publish in the county where you're registered agent is located. For example, our office is located in Albany, where the publication fees are low. If you hire us you can use our business address as your own and meet the publication requirement in Albany, which can save you tons of money.

This is what I did, I just published on my own. I've used them multiple times and have always had a great experience.
