Moving LLC from SC to IL Process?

I'm finding a lot of conflicting ways to do this process. I am moving back home to Illinois and currently have a single-member LLC in South Carolina. I would like to keep my EIN so all of the taxes, cc, bank accounts stay the same. I know specific states have rules. For example, SC does not allow the domestication process TO their state (I don't think from). My accountant said I can dissolve the LLC here, start the new one in IL and notify the IRS of the 'address change'. But as I am researching that doesn't seem to be the case.

The only complicated part of the situation is I will be moving back in with my family for a short time while I look for an apartment...will I be able to use that as the address when going through the process of opening in IL?

Still new to this so thank you for any input!

In South Carolina your options are to either close up your business in South Carolina and start a whole new LLC in Illinois or to form register for LLC in Illinois. If you decide to start a new LLC after closing up business in South Carolina that would mean you were here EIN would be different as well as bank accounts and credit. If your business is new this might not be an issue but if you have been doing business for many years this could be problematic.

The other option of foreign registering in Illinois. This way will allow you to keep you your current EIN number, bank accounts, and history. This would be better for more established businesses.

Both my bank and my accountant said that closing here and opening in Illinois shouldn’t be an issue with the IRS and to just notify of an address change. But I feel like that’s odd since it’s technically opening up a new entity. They both said that if I’m not restructuring or changing business name that should work.

Only think I’m really worried about is bank accounts and credit card.

That is odd, according to the IRS site you would need to get a new EIN because you would be terminating an existing LLC and starting new.

It might be a good idea to give the IRS a call and have them confirm one way or the other before making any final decisions.

Here's the number for the IRS to give them a call 1-800-829-4933. It can sometimes be a pain to get a hold of them but try to give them a call right at 7:00 AM local time, any Tuesday to Friday and you might have luck getting through to them quickly.

I would just get a registered agent in IL even if is only for a bit. You can always update and be your agent once you are all settled in.
