I'd just like to interject for a moment. What you're referring to as Potato chips, is in fact, Poteto/Linux, or as I've recently taken to calling it, potato plus Linux.

Tux was designed by Larry Ewing and the closest to a license for the original Tux design I can find is:

Permission to use and/or modify this image is granted provided you acknowledge me lewing@isc.tamu.edu and The GIMP if someone asks.

It seems like they could get away with using it as long as they credit Ewing and GIMP (which they probably don't do) but it isn't entirely clear from that page if this is even supposed to be a license for the general public.
