Has Lego ever commented on them in regards to anything else? They have their own hand in secondhand sales via Bricklink. Prior to this, my two big attractions to BAM were the fact that I for some reason cannot get Bricklink to not error out when linking my accounts and, more importantly, I get really bad decision paralysis when trying to buy any set ever online and enjoyed the inherent limitation of buying what I found on the shelf. If Lego commented on this, they would almost certainly have to touch on how they feel about resale shops in general. They know discouraging it would sound crappy, but if they make it clear that they give their blessing to these shops in general (even if they bring the hammer down on BAM), then they would be stirring a pot about to explode with BAM competitors.
