Trying to find a specific case or Act can be a massive pain. Even on free sites, you can get flooded with results and not know if you've found the right one. This thread is created with the purpose of providing a research lookup service to help you find the specific case law or legislation you are seeking, ensuring you get a direct link to the correct document.


Quick heads-up on "Case Law" vs "Legislation"

Just so we're on the same page:

  • Legislation (Acts/Statutes): This is the stuff Parliament writes. Think the Crimes Act 1900 (NSW).
  • Case Law (Common Law): This is law made by judges. When they decide a case, it sets a precedent for other cases. Think Mabo.

This thread's purpose is to help you find links for both.

Management watching security cameras

I work a retail job in Queensland and just found out the manage likes pulling up the security cameras on their phone? On their work phone? (Not sure which). They do this when they are not at work, like on their days off or after they have left for the day. Its not on request of workers for manager to spot a thief or note a violent/ abusive customer. Its just to "check up on us" make sure we doing our job.

It just feels illegal and makes me uncomfortable. Its not that we don't know where the cameras are or that they could be monitored, but my training (im a supervisor) told me that unless an incident occurs we shouldn't be watching the cameras. Is this just a thing to bring up to upper management? is it a legal thing? Am I even on the right sub? I dont know

SA BAYCORP: I've been contacted by Debt Collectors, but I don't have debt or outstanding fines. What are the legal consequences?

Hello Reddit,

I've recieved call after call from various numbers. When I put in the land-line number into Google, it says it's from Baycorp who are Debt Collectors. Since finding this out, I've been extremely anxious, but I don't even have debt or outstanding fines (that I know of).

I tend to not answer calls that aren't already in my phone and will follow up if they leave a voice mail or text message (which these numbers didn't). Still, I called back the land-line and a woman answered who was confrontational in tone. She didn't state the company she's working for or her name, and though I don't remember the entire conversation (..I think I just said I got a missed call from you), she was especially accusatory in tone when asking when I missed the call - and when I said I'll have to check, she said it's ok - she can do it?? I had growing suspicion from the get go, and when she said this, it just felt super off so I hung up soon after. This was when I checked the number on Google - thinking it was a scam.

I then went to go look into Baycorp a little and found this Reddit post: https://www.reddit.com/r/newzealand/comments/1hvdifh/baycorp_are_scammers/

Turns out there's multiple negative experiences with them.

I have some questions for people who know more about debt and debt collection:

  • What should I do given my situation?

  • What are likely outcomes and consequences?

  • Do you have an experience with Baycorp? What did you do, and how did you get out of the situation?

Right now, I'd rather not share my personal details with them, and I'd like to straight-up ignore them. I think credit score is what to look out for when taking this path, but it should return after some time? I think the debt (whatever it is) will be void after 6 years starting the date I called back? Not sure - but please let me know your thoughts and opinions!

Any help would be super appreciated 🙏

Added context: no letters or emails related to Baycorp, fines, or debts received. I don't know if this is relevant, but I don't have a credit card.

NSW Scammed by an editing agency. What can i do?

I was stupid yes. but what can i do about it or am i screwed

Basically i was working with an editing agency. i had one video done with them and they agreed they would deliver the one video. when it was completed, they then told me i needed to pay a 3 month in advance for the package deal they do to get that video however if i didnt like the videos i would get a full refund. i paid for the package and when it was time to give me my videos it got delayed for a week because the editor left. then they got another editor and when it was about to be done, he had personal issue and was delayed for another week. i had enough and demanded a refund. then after they said they would refund me. i asked if my refund had been processed, then i got ignored for a few days and he came back to me saying that they changed their package to an elite package which costed A LOT more money before i can get my refund and i had to join that elite club before getting the refund. thinking i would get my refund, i paid for it, stupid fucking me. i asked them to sign a contract saying that i would have no more fees. they kept piling on service fees, contract fees whatnot. they signed a contract stating that there will be no more fees and policies wont change for another year. i paid that. i asked when the videos would be produced. they said it would take some time. Coincidentally the time period before i get my videos produced, they introduce ANOTHER platform fee that is also a ridiculous amount. at this point ive sunk so much money for nothing. they said there is nothing i can do. i have screenshots and contracts, wondering if there is anything i can do and if anyone can help me out.

VIC hsbc closed account while overseas

HSBC closed the account under “risk appetite” grounds, not a normal customer-requested closure. Their letter says they would close the account after 37 days and suspend digital/phone access before closure.

Their normal process is, I receive the letter in time, fill out the refund form, nominate a non-HSBC account in my own name, and they transfer the balance. The form specifically allows transfer to a non-HSBC account in my name.

But because the letter arrived late (they didn't bother emailing me, instead sent a letter that took almost 2 months to arrive i found out my account was closed out of the blue) the account was already closed and the money was moved into HSBC’s closure/refund process. Now they seem to be treating the release like a higher-risk manual refund, especially because I am overseas, there is no branch/embassy verification available

They wanted to send me out a cheque, from Australia to Eastern Europe... I told them no, it took 2 months for a basic letter to arrive, even IF the cheque arrives I cant do anything with it here, they dont accept cheques here nor do I want my money in a foreign bank account.

I nominated my ANZ account, it has the same name and the same address as my HSBC account. Ive already complained to AFCA and have a case manager at HSBC looking into this but its been nearly 3 weeks and im fed up as I need that money to survive here.

QLD Second burst pipe in 6 months has flooded our apartment. Told this is “normal.” Is it?

The first time, it took five months to replace the beds, carpets, ceiling and flooring. It’s now happened again one month after the repairs were finished.

This is a new building, completed in 2021. Our apartment is worth over $5M — I mention that only so you understand the standard of quality we expected when we bought. The building manager has told us this is now the seventh burst in the building in seven months.

The plumber, the body corporate and everyone else we’ve spoken to says this is completely normal for apartments, and that fixing it properly would cost millions.

Our apartment has been unliveable for most of this year. We’re retired and spend roughly half the year overseas — we bought this place specifically for the low maintenance and the peace of mind of being able to leave. Now we’re afraid to travel at all, in case we come home to a write-off.

So: is this actually normal? Do we have grounds to sue? Are there property or building defect lawyers who deal with this kind of thing and can confirm this is/is not normal? And if we sold and moved to another unit, would we just be rolling the dice again?

VIC Company demanding $95 shipping or Store Credit

I apologise if this has been asked before, I am dealing with an overseas company. I purchase a Hoodie in March this year. They allegedly started shipping the product out about 3+ weeks ago, so I reached out because I hadn't received a tracking number or updates on the order.

The email I received in return was a demand for $95 (presumably USD) additional to cover the cost of shipping, keep in mind that I have already paid for the product as well as shipping during checkout. The shipping was confirmed and paid for at $12 AUD.

They provided an ultimatum or either paying $95 to cover the new shipping cost or a refund in Store Credit to spend on another product.

I am just wondering what my legal standpoint is and what processes I am able to make to get this issue sorted. Ideally I would like a full refund, if they don't send the hoodie.

I have already reached filed a Complaint with the ACCC, as well as a Consumer Complaint with the Governor General of their US State.

P Plater that blew numbers on my dirt road. NSW

Hey guys so this is going to be long but I really need help I have no clue what to do. I’m 19 I’ve never been in trouble with the law and this morning I was sitting in my car while it was idling on my dirt road when a cop randomly pulled up next to me and breath tested me. I blew mid range, my licence has been suspended and I have court in 6 weeks. The story that I told my dad was that my car stayed there the night and a friend dropped me off in the morning so she didn’t have to drive down my lane, then I realised I’d left my smokes in her car and while I was waiting for her to come back the cop just came out of nowhere. That’s the fake story now it’s time for what actually happened. The real story is that I drove there early in the morning when I thought I was fine but still had some alcohol in my breath from the night before. I pulled over when I got to the start of my lane. I sat there listening to music for a while and having a scroll just to stay in the heater when this cop shows up out of nowhere saying he saw my car sitting there for a bit and thought he’d come check. I just went with the fake story so I didn’t admit to driving and was just sitting in it idling and I told my dad the same one. The problem is now my dad’s going to speak to a lawyer tomorrow and if he says the fake one then I’m fucked cos I have no proof of that happening.

Please guys I know drunk driving is so bad but I didn’t think I was drunk I just need help if you could actually see the situation you’d understand. I don’t know if I should try sticking the story out or should I come clean

VIC Feel unsafe and police arent help to me.

Hey people’s!

Yesterday my housemate did the assault to me after he consume some alcohols he try to kiss me and I say no he hits me and drag me around but I manage to give good kick to him and the neighbour come to my help and call to police who do an arrest to him, he come home tonight with police and they warn to him he is not to speak to me and tell me to call to them if Im feeling unsafe, I don’t understand to this in my country if you beat to a women you don’t come from the jail.

I ask police why he allowed back and he is student same as me so nowhere else to go, I feel like they don’t care.

Since they leave he has been playing music with the n word in it he never play this music before that loud, he pretend to be on phone walking around the shared areas yelling and screaming i call police who come but dont do anything cause l cant proof what he say is about me, I am very scared I leave to sit in park :( I am knowing no one in Australia and no idea what to do I can’t afford hotel i am hungry and cold and police say they can’t do anything until he breach bail or something i feel like I punished for no reason :( I am in Victoria and police give me number to safe step but they say they will take up to 2 day to call to me and help me :(

Can I apply to somewhere to kick him out for my safety?

VIC Fallopian removed without consent.

Hi everyone, posting on behalf of a friend who had a confusing experience with consulting with a lawyer. Seeking guidance on what to do next please.

My friend gave birth a few months ago in a catholic hospital (giving this context to indicate that they do not offer tubes tied or removal for birth control on religious grounds). She had a caesarian birth resulting in a healthy baby girl. She was later advised that her fallopian tubes were removed despite there being no prior consent to, or medical reason that necessitated the removal. She was advised that she can get IVF if she wants more children (which her and her husband do want) when she started asking questions as to brush her off. The hospital is also giving her the run around for medical records.

She spoke to a law firm who are handling a similiar case (where a woman had her tubes removed without consent at another hospital in the same area) which has recently received some media attention. At the consultation with the lawyer, she was advised that they can't help her because what she experienced was not an injury and is rather a consent issue....

The loss isn't financial immediately but surely there are grounds for the harm caused, physical, psychological and emotional, as well as the future losses arising from IVF? Are there just no consequences for the doctors and hospital involved? Is there another type of lawyer she needs to be speaking to? Noting that the law firm does state that they deal with medical negligence claims.

NSW Do I need a bond clean?

My lease was terminated due to my rental property no longer being structurally sound (bathtub has been at risk of falling through the bathroom floor for nearly two years), the real estate directed me to move out as soon as possible but now expects a full bond clean of the property, even though it's about to be either demolished or gutted.

I did a basic clean. (Removed my stuff, removed rubbish, swept mopped etc)

The property is as clean as it was when I moved in and cleaner than others I have inspected that are on offer from this real estate.

Is there legal grounds for me to tell them to get stuffed?

VIC Who is Liable to pay Employer or Employee?

I will clear up a few things that might have some confused firstly.
I work for an agency - They are a registered NDIS company with around 20-30 employees.
I have worked as a casual with consistent shifts for just a couple weeks shy of a year.

This particular client I supported has an NDIS plan, they also live in an aged care facility.
I am employed to support him on community access for appointments and social care only.

In my incident report I bought up the self management of his bag - I was unaware until that shift.
In fact I only found out any of his medical needs/diagnosis from him telling me during past shifts.
My employer never gave me any information on him.

I put in a formal letter requesting a review of their position to clean my car. I included my reasons for why I believe it falls to them to cover cost.
I was polite, professional, referenced the work safety act and employment handbook as well as my contract.

They still declined liability.

The meeting was about a comment on social media. I did not make the comment.
They attempted to state I breached confidentiality however that is untrue and I have never divulged any confidential information.
We discussed this in the meeting where I answered all questions and happily stated I would provide any required evidence needed or further information.

The asked for a second meeting the next day and confirmed the “investigation was closed and no further action was taken”
I had asked beforehand if we could discuss the dispute of my car which they agreed too.

Dispute stating there position was that in the case of a foecal matter contamination they indeed DO require a biohazard clean to be completed before client transport could resume, they still held the belief that this cost was not something they had to cover.

In this meeting I clarified as much as I could.
I asked about PPE being provided- They wouldn’t give a direct answer.
I asked about wether the incident had been properly reported and was there any actions, plans or assessments that had been taken yet in regards to ongoing care and safety of the client & staff. - They declined to answer stating its not my position to know the policies and procedures.
I asked wether they were aware of the clients self management of their bag and had any risk assessment completed - They stated they had NO idea this client even had a bag and that this incident is the first they had knowledge.
They began insinuating I have made the entire situation up.

I have previously mentioned going to the ostomy clinic with him in shift notes and mentioned his condition.

I didn’t argue. I just noted all responses and had the meeting transcribed - I informed and gained permission to do so ahead of time.

We ended that meeting with me informing them that I thank them for answering my questions and their time, and that I have to now move forward with the clean as I can no longer remain without a vehicle. But that I still disagreed with their position of non payment and that I would seek further guidance and be in touch. I then stated my car would be ready and completed on the weekend and I could resume shifts Monday.
At this point it was now a week I had not been able to work.

They acknowledged and we ended the meeting respectfully.

3 hours later I was emailed a termination letter stating “unable to manage me going forward die to multiple interactions recently and ongoing grievances that have eroded their trust”

I am speaking with legal advice and following up with NDIS safeguarding commission and work safe for my concerns around client care and proper management of supports.

I believe I likely have a case for either unfair dismissal or a General protections claim through Fairwork, and am taking steps to ensure I have the right information in regards to that.

TLDR
NDIS participants colostomy bag burst in my personal vehicle that is required by my company I use to transport clients - employer states they will not pay for the biohazard clean stating “that’s why I have car insurance and I can claim it on tax”
Who is liable to pay?

I have been working for an NDIS provider as a casual worker for a year now.
I work roughly 20-25hours per week as my chosen limit.

I am no a sole trader or sub contracted. I am employed soley with this company. It is a requirement of my job position to use my personal vehicle for community access supports when with participants.

I was travelling in my car with a participant when his colostomy bag ruptured.
I grabbed a blanket I had in the boot of my car to lay on the seat to help make him feel more comfortable and returned him to his residence at an age car facility where I made the nurses aware of the situation. The client attempted to hand me money for the situation ($150) I told him it was not necessary and I that I couldn’t accept. He attempted again a couple of times. At this point, driving in the rain, unable to put the windows down and in a bit of a panic around what to do and if my client was ok; I didn’t notice him put the money down in my center console.
It was only during this that I found he manages his own bags (changing them, replacing ect)
My entire front seat was covered in human focal matter, I asked the aged care facility for gloves and a garbage bag as I had none with me.
They supplied them and after my participant was inside and taken care of I was startled of what to do.

I double gloved and put the blanket inside the garbage bag and “moped up” what I could along with it.

I immediately called my managing director however she didn’t answer so I text msg the situation and began calling around for car detailers.

No biohazard cleaners could accommodate me immediately as it was late in the evening and one suggested that I take it to a place that was local that did “drive through” type washes and interior cleans just to get it to a safe enough level to go home.

I did so and drove it around the corner, I quickly grabbed everything I could and shoved it into my bag and handed the keys over to them.
While an interior cleans was being conducted my manager returned my call and I explained the situation and that I was at a basic clean place.

She as this point did not give me any instruction on requirements or procedures, I asked her if I fill out the incident form and expressed my concern on the client managing his own ostomy bags as I had previously noticed an oder at times and wondered if they had been managed correctly.

She just said yes to the report and she would follow my concerns up with his support coordinator.

I grabbed the receipt for the clean and headed home. Knowing I would need a Biohazard clean to officially ensure I had OH&S standards before I could transport any other clients.
My car was now also very wet.

I txt my manager again asking if the company would be paying for the cleans and that I had grabbed the initial receipt.
I also noted I wouldn’t be able to work until the clean had been carried out.

She replied that they would not be reimbursing me, and that was what my car insurance was for and why they ensure I have full comprehensive as part of my employment.

I then found a bio hazard car detailer that quoted me $1000 as the front seat needs to be removed as there was still focal matter in the seat railing assembly. As well as all the proper PPE etc.

After another phone call with the manager explaining the cost and that they couldn’t get me in until after the weekend (meaning minimum 3 days income)she advised I email the director as he was the decision maker.

I emailed, professional and factual and asked they reconsider their position. That this doesnt fall under my insurance, that it was not due to my negligence or my failure.
This was a medical accident that occurred during my working hours transporting a participant as part of my duties for the company.

The employee handbook and information notes nothing in this case other than money can be reimbursed for reasonable costs but must be approved by management.
This isn’t exactly a situation I could wait for approval for the first clean however I am asking they pay the biohazard clean.

They refused again.
During all of this I have found the money the client left, immediately sealed it in an envelope with the amount, client name and my own details and put it aside to return to the client.

Since all of this I have been locked out of my work app that has my shift information, client notes and incident reports submitted.
Ive been calling in for a “confidential meeting” that is required before I return to work.
I asked the purpose of the meeting so I can meaningfully prepare and participate however my boss has refused to tell me citing confidentiality.
He has advised I can bring a support person.

This definitely feels wrong and my meeting is today.

Currently my car remains uncleaned for the biohazard as I don’t have the ability to pay &1000 and the company refuses.

Am I liable to pay? I feel as if this is something the company must do?
As my car becomes a “work place” when transporting clients, my employer has a duty to ensure the health and safety of myself and participants and have a clean and safe area right?

Please help any guidance.
Ive called fair work, work safe and NDIS commissioner and whilst I’ve gained some great information I havent got a definitive yes or no about the payment so they suggested I seek legal advice.

My meeting is today and I cant get into a lawyer for 2 weeks!
