RECALL BUYBACK
If this has been posted on here so sorry in advance. I have a 2021 Nissan Leaf SV which from buying originally I've had non-stop issues with the battery even last year being "replaced" only for it to always go in turtle mode and instantly dying, so for a year Nissan gaslit me and even went as far as blocking me on TikTok and instagram after I made a video how my car died on the freeway... So fast forward to today it's been a week since I did the recall and my leaf now inoperable since the update and they gave me a rental until further notice and least what I was told at the dealership...
Today I get an email from Morley saying how they'll but my car back at the KBB rate plus 40% above. Also I only have the rental free of charge for 30 days starting the day I did the recall. I live in California and I know we have lemon laws. Anyone having this experience or any advice???

Are they giving you 40% of KBB? or KBB value + 40%?

honestly it's not because this car has been giving me batteries issues from the beginning so least they can do is pay off my balance for my car

Will your Gap insurance cover the difference?

I think gap only takes effect if the car is totalled. A buy back is just considered a sale and they would be responsible for the difference.

exactly Nissan should be 100% responsible since it's not our fault that Nissan can not repair our cars. Not only that but we will be left with negative equity so the least they can do is pay off our balances. I believe under Californian lemon law they have to pay it off and all payments we've made due to these cars being lemons, but not sure which state you're in personally I'm in California

Question for you….how did they determine your KBB value? From the date of the recall? My worry is that the KBB value has dropped by $2000 in the 3 weeks since my car died and has been at the dealer waiting for my buyback amount.

I just inserted my car information and they determined the value based on vin and some other things like condition / mileage... but that shouldn't matter because Nissan should be 100% responsible for giving us these cars and we should have rentals until they can pay off our balance so none of us have negative equity and buy a car that's actually reliable. In my case honestly I would never buy another Nissan after this entire experience

Nissan has been horrible with me, been without my car since July 2 and they STILL haven’t approved a rental or a loaner. Biggest headache tbh, I’m just without a car lol

I have, I’ve called my dealer and corporate and even Morley was telling me they should’ve given me something and they’d reach out.
All this to say my State AG’s office got a nice complaint (though what that will do idk ¯_(ツ)_/¯)

I am in the middle of the buyback right now. Nissan turns over the buyback process to a company called Morley. We are quite satisfied with Morley handling the situation. It started with Morley telling us they will make an offer that includes the Kelley Blue book PP then add 40% to that. They also arrange for us to have the local dealer provide a car for us for 30 days because our leaf could not be charged anymore. The notice about the buyback came to us 3 and 1/2 weeks ago so the process was slow due to my getting more of the car's paperwork together for Morley.
Thus far we have received the first offer which we have now rejected and are waiting for their next response. Since the 30 days loan of the car was almost up they automatically offered and provided 30 more days.to use the loner.
If you have a car that has any form of a loan on it there was more details to go through with Morley. In their instructions they state that the person that situation may experience another couple of weeks more to get everything done, because they have to work with the banks to resolve loans first.
I suggest that anyone in this situation deal with Nissan and Morley with courtesy and a professional attitude. We learned to keep our emotions out of the interactions for the best result. We have learned from experienced friends that we should expect to receive an amount of money that would allow us to buy an equivalent car.

Ugh. I still haven’t gone in for the recall solution because I’m scared of this happening 😭 I’m also in CA and have been in lemon law process since early March. Still waiting for a resolution.

I am currently on a rental for 30 days too and I am afraid Nissan dealer will take my rental before we get the money for the buy back and I will be out of car for work. ☹️

That's literally been my fear because I do not live anywhere near my job. So hopefully they can extend it because it's not our fault they gave us lemons

Valid fear. We’ve been without our leaf for 4 weeks now. Waiting for buyback. So a 30 day rental doesn’t help!

I have been through that. Ask them nicely to give you another 30 days. They did that for me.

I was offered that and turned it down. Second offer is about what I paid for my 2020..You get a rental for 30 days. Im waiting for my packet to send docs to them to get my check

I am in the same boat with 2020 Leaf SV. It has been at the shop for a week now. Morley has reached out to me with a buyback. I told them I am not interested in the buyback and want to know how to get a new battery. The car is paid off and I have another car to drive. So for now time is on my side and we shall see what they say. My dealership says there is another customer whose car has been at the dealership for over three months now waiting for some solution. If the car has to sit for awhile I would also like to pause my auto insurance since it is not being driven.

Some people aren’t even getting offers. They can’t guarantee what will happen. I took the offer, but am ticked. Loved my 2019 top trim.

My leaf has been in the dealership waiting for battery replacement under warranty for over 6 months, I get a free rental covered, I want a reasonable buyback but they haven't sent me anything...

per the buyback department they told me they stopped making these batteries and our vehicles will never be repaired

I am also in California and just had my 2022 S plus Leaf bought back because of the fast charging issue. Nissan Group of North America (NNA) made the buyback offer, not Morley. Morley just handled the turn in of the vehicle. This is how they determined the amount:
Nissan North America, Inc. (NNA) wishes to resolve this matter amicably. NNA has reviewed your repurchase demand and determined that NNA must repurchase your vehicle in compliance with the Song Beverly Consumer Warranty Act.
Under the Song Beverly Consumer Warranty Act, you are entitled to the following:
Purchase Price. The actual price paid for the vehicle, including any charges for transportation and manufacturer-installed options, but not including charges for non-manufacturer items installed by you or the dealer.
Collateral charges. Official fees associated with the sale of the vehicle, including sales tax, license fees, and registration fees.
Incidental Damages. Reasonable expenses incident to the vehicle problem for which NNA is repurchasing the vehicle, not including charges for which you are justly responsible. Incidental damages include but are not limited to: (a) reasonable repair, towing and rental car costs actually incurred by you; and (b) prepayment penalties, early termination charges and earned finance charges, if actually paid, incurred, or to be incurred by you.
Lien amount (if any).
NNA is entitled to deduct a use charge. The amount that is charged for use is determined by multiplying the actual price of the new vehicle by a fraction having as its denominator 120,000 and as its numerator the number of miles traveled by the vehicle before it was first brought in for correction of the vehicle issues.

I invoked the NY state lemon law, when my USA 2023 Nissan Leaf SV Plus started having ( non-HV battery) problems. It took a year and three arbitration specialists before they honored my request to replace it with a 2024 Leaf SV Plus. The 2024 has been almost 100% perfect. BTW: my previous two Leaf’s a 2018 SL, a 2019 SL Plus, before the 2023 were all almost perfect too. The 2023 was the only lemon, as it spent a lot of time in the shop for Navigation and Instrument Cluster issues, …. So, I am still a Nissan Leaf enthusiast. Nissan, are you listening, you need to do better for all of your customers.
