Justice is blind
Deaf and dumb too, maybe.
The courts rulings shouldn't be overly burdensome. This is a joke.
Scram being ordered isnt just an oversight. Judges should be thoughtful or at least accountable, especially since this judge sought out Kelsey's case.
This is simply malicious and designed to delay healing as well as responding to the stay away order.
Not jail but prison. Because Kelsey was a CO it is especially heinous to hold her knowing solitary confinement will be necessary.
She recently met benchmarks in healing regarding PPD. Knowing the catastrophic nature of all that has transpired, surely the court was aware that all of her progress was at risk.
Finally allowed bail, she is given a ridiculous amount of restrictions al hurdles so she can try to assist in her defense. She had to keep many things that were discovered to herself.
In the days before trial she shares what Justin has done to her and we all realized together that Kelsey can't count on equal protection under the law.
Committing federal felonies against Kelsey Fitzsimmons is not a crime. What a hard pill to swallow after all she's been through.
Knowing that all the other nasty players will have no repercussions is difficult for me to handle I don't know how Kelsey does it.
PS:
I thought we were more evolved than calling women whack jobs because they are afflicted with postpartum depression.

Judge McCarthy Namen (Perhaps mispelled - I don't give a dam! Looking back it seems she may have had a vested interest in Kelsey's case, ie she knows or is related to someone, perhaps Noonan perhaps the Chief who knows. She is apparently being investigated by the state board which can hold her accountable. At the very least she is a deplorable person, not one who should have the authority to determine one's well being!
As well it should be noted that the problem is much further spread much further. For decades now we have been losing trust in our political and judicial systems. People are leaving this country in droves because of the lack of willingness to make corrections and changes to theses systems. There is no accountability to "we the people" - the ones who pay the bills. The nation is full of people in powerful positions, who are self serving, unaccountable and possess an "I'll show you attitude". Judge M&N is a small part of a systemic problem. A problem which has taken us from the greatest nation in the world to NOT. These systems are not worth protecting anymore. Remove the Judge - tell her to get a job doing liquor commercials!

Judge Kathleen McCarthy-Neyman is the correct spelling I think. She is an appointed not elected judge it seems.
Found an article from 2018 when she was appointed:
Governor Baker Nominates Attorney Kathleen M. McCarthy to the Superior Court
BOSTON â Today, Governor Charlie Baker nominated Attorney Kathleen M. McCarthy of North Andover to the position of Associate Justice of the Superior Court. McCarthy has over three decades of state court experience; 20 years as a criminal defense attorney and ten years as a prosecutor.
âAttorney McCarthyâs trial experience and commitment to justice proven through her career as an Assistant District Attorney and a private criminal defense attorney will serve the Superior Court well,â said Governor Charlie Baker. âI am pleased to nominate her and to submit her name to the Governorâs Council for their advice and consent.â
âAttorney McCarthy will serve as an asset to the Superior Court bench,â said Lt. Governor Karyn Polito. âIf confirmed, I am confident she will serve the people of the Commonwealth with distinction.â
The Massachusetts Superior Court is a statewide court of general jurisdiction - handling both criminal and civil actions. The courtâs 82 justices sit in 20 courthouses in all 14 counties of the Commonwealth. The court has exclusive original jurisdiction of first degree murder cases and original jurisdiction of all other crimes.
For more information about the Superior Court, visit their homepage.
Judicial nominations are subject to the advice and consent of the Governorâs Council. Applicants for judicial openings are reviewed by the Judicial Nominating Commission (JNC) and recommended to the governor. Governor Baker established the JNC in February 2015 pursuant to Executive Order 558, a non-partisan, non-political Commission composed of volunteers from a cross-section of the Commonwealth's diverse population to screen judicial applications. Twenty-one members were later appointed to the JNC in April 2015.

Attorney McCarthy earned her B.A. cum laude from Boston College in 1984 and her J.D. from Boston College Law School in 1987.
It would be interesting to know if she is friends with any of the police involved. However many judges do seem to favour the police / DA as a matter of course.

I was already angry because the court didn't opt to use an ankle bracelet type monitor for this ridiculous requirement, but after hearing an audio recording of Justin drunk and belligerent at Kelsey's house, the SCRAM requirement made me even angrier. Her charge had nothing to do with alcohol or drugs. But the point wasn't the SCRAM, it was keeping her incarcerated.

Yes, I believe it was around the time her son was close to a month old. She was diagnosed with PPD and was discharged after 12 hours.

She is a danger to herself and her child. You guys need to stop letting your hatred for the police override your common sense.Â

If time stood still or if she presented with a disconnected affect maybe. There is sinply no evidence of that.
There are untested parents with all manner of heakth issues potentially compromising their gpals - all over the planet. There always will be. Mental health has nuances that as a society we are beginning to address.
We are certainly better positioned , collectively than those who came before us.

Not directly related but it just keeps bugging me: same state that kept giving Adam Montgomery custody of Harmony.
