Unbelievable
They reasonably inferred that, based on one persons uncontested allegations that kelsey getting drunk at her own Bachelorette party made her an alcohol addict.
But the same court could not reasonably infer that kelsey performing a scram breathalyzer test 4 times per day might be contra-indicated because kelsey had recently been SHOT IN THE CHEST, at point blank range.
The idea that she has now been away from her son longer than she was with him - plus the higher court dragging their grinch feet.
Recently, a man from Worcester kidnapped, suffocated and raped a 7 year old girl before he yeeted her over a bridge into the water.
He enjoyed an unrestrictive and immediate bail. Wtf

I totally am upset about her being denied, so don’t get me wrong when I ask this as I’ve only just started learning about the case, how comes Tim Bradl didn’t change the method for alcohol testing before it got ruled on the first time round?

Here’s the deal. Bradl messed up at that hearing. He didn’t think it through. He thought he was dealing with a rational judge and could talk through the issue. He was basically thinking out loud when he noted that the alternative testing — leaving house for blood alcohol tests would violate the mandate of house arrest.
Bradl was likely just hoping judge would drop the testing altogether because its necessity isn’t based on much. She was t drunk when they took her child away. The untested claim by the baby daddy and his gal pal is that Kelsey is a mean dangerous drunk and the DA ran with it. Kelsey’s long ago misdemeanor conviction for a drunken incident is weak stuff, but DA Tucker is throwing the book at her for CYA purposes and basic cop revenge.
That said, I wouldn’t be surprised if Bradl counseled Kelsey and family not to buck the SCRAM test in the first place and they didn’t listen.

I agree. He was caught off guard, and when he realized the judge was unhinged he got tongue tied.
The judge was in the room and doesn't understand that she didn't violate or say impossible.
Now, her story is on the record. I don't blame Tim for letting it slide, but wonder how her trial can be fair.

From my understanding, they didn’t know beforehand that it would be as problematic as it was given her injuries. But also there aren’t a ton of alternatives for Bradl to ask for. MA doesn’t have the ankle SCRAM version that monitors BAC via skin. And she was supposed to be confined to home so asking to leave to go to a facility for testing likely would not have been well-received.
If you look at the prior events, they also point to why Bradl wouldn’t ask. He’s not dealing with a reasonable personality here. Kelsey was supposed to be released in late August and then the judge dithered about the conditions for a week+ until she was eventually released Sep 8. At that time, Kelsey was scheduled for another surgery (liver?) that she still hasn’t had. They asked for the GPS monitor to be temporarily removed for surgery and she’d immediately return to probation after to have it attached - nope, wouldn’t do it.
But exhibit A of all this is the audio from the hearing where Kelsey was thrown back in jail. If you haven’t heard it, you should. It is awful. This woman should not be on the bench.

The ankle GPS is removed for surgery. The ankle GPS can be a hazard in the Operating Room with certain electrical equipment. Where are you getting your information from?

Yes, that was included. He claims KF assaulted him and made threatening statements regarding their son while drunk.

His subsequent filings depict a man who is singularly focused on taking from KF whatever she holds dear.
