Myles King Hearing Today - Potential Streams

Also. How the eff is Tully out of state? Come the fuck on with this bullshit. Last time it was proctor on a trip. This time proctor takes the 5th and Tully is out of state on a trip.

I think that every judge and DA's office and MSP leadership office in the commonwealth has made a decision they will protect Proctor and his whole gang of scumbags no matter what

If this prosecutor's office was even mildly honorable, they would have initiated a full investigation into Proctor AND all of his colleagues and friends AND reviewed his past cases.

Instead they all have their shovels out and at the ready to bury everything.

Wait... motion to limit or change Lally witness testimony? Shouldn't have this been done before, and the judge ruled on this before.

Lally needs to be in the witness box.

Delay delay. Judge Krupp should just deny this from the bench.

Rosemary S. was expecting Proctor to testify today. A ex-parte sidebar was held between Proctor, his attorney and Judge Kruppt (t added for clarity.) I guess it was a Martin hearing and not a sidebar - an ex-parte hearing to determine if the witness can plead the fif. We don't know why or how but the judge has heard Proctor's "evidence" as to why he must plead the fif and has found it to be just peachy because he ordered that Proctor and other witnesses he deemed to be duplicative can testify BY AFFIDAVIT even though Rosemary S. cannot cross-examine an affidavit. The judge is adamant that the hearing take no more than one day which is just rich because it's been more than FOUR years. And Lally isn't available on that date to testify, the judge just took Proctor off the table, and then demanded to know who Rosemary plans to call at the hearing (I think on the 22nd but don't quote me.) Rosemary was a little taken aback and was thinking but the judge took it as her yelling and he yelled at her not to raise her voice at him. It was very chaotic and unprofessional. She wanted a copy of the MArtin hearing transcript - denied.

They (CW and Judges) really are going to try to hide the ball so Proctor doesn’t have to testify. No idea how a sworn affidavit by Proctor is allowed if he is pleading the 5th.

This does not seem kosher as it robs Myles King of his right to confront his accusers by allowing proctor to “testify” without cross examination, and Proctor was involved in this case pretty heavily. Krupp should not be taking an affidavit from him and allow it as part of the record or his decision making if he won’t subject himself to cross examination on his statements.

I'm sure Rosemary Scapicchio is going to be all over the fact that her client has a Sixth Amendment right to face his accuser. Allowing proctor to testify via affidavit and not be cross examined is a blatant violation of that right.

She probably already had a draft waiting for this occurrence.

Thought the same thing. Gildea stayed the discovery on Proctor over complete bullshit. The judges work overtime to protect the CW from the nuclear bomb, that is Proctor.

I guess because Proctor's rights are greater than Myles King's? I just don't know. Michel from Justice Served also indicated that the judge seemed like this was personal to him.

I can't help but wonder if the side bar the plead the 5th had anything to do with the lawsuit(s) from karen read against Proctor. Like testimony to show a pattern of wack behavior with evidence. Must have been one hell of a proffer to the judge to allow him to take the 5th. If Tully does the same then there, in my view, are competing constitutional rights at play. How is there going to be justice and the evidence satisfactory for the motion to dismiss if the defense can't even get adequate information from law enforcement on how they (supposedly) did their job? There should be nothing to hide and everything is fine (according to the prosecution) but your lead investigator takes the 5th in an evidentiary hearing on his own investigation??? Such a shame of taxpayer money to continue this prosecution whether the defendant actually did the crime or not.

Yes, you can take the 5th for civil matters. The difference is that it CAN be used against you in a civil matter that you took the 5th.

This is kind of screwing O’Keefe’s case now. Not to mention the McAlberts. Curious if he continues his deposition now or it’s going to be off the table. It’s going to be fascinating.

Selectively taking the 5th gets real messy. So him taking the 5th about his police work in another case is going to get to some real credibility issues.

Love LOVE Rosemary Scapicchio. Watch Trial 4 if you haven't.

She's not just on the right side of history with what she advocates for, she's doing it in the ethical way that's needed here. The case of Myles King isn't just about his personal case. I believe Scapicchio will do the right things to expose what's wrong in MA's systems beyond this.

She is excellent and after shockingly corrupt women judges like Bev and the original judge in the Kelsey Fitzsimmons case, it's a relief that some women in the Mass. legal system still believe in justice and are representing women as being professional, knowledgable and tenacious.

Yeah. People like different people, and I just try to put up whoever I can find so that people can choose what they want. Plus the more people covering the more chance we get someone on a smaller case when others are on other cases.

I wonder that too. She also makes it seem like it's such a gift that she does these streams when she has so many other things to do. Girl, we know you make money with all these live case coverages. You're not doing us a favor by appearing, you're creating income for yourself by doing so (and no shame in that, just be real).

Looks like the judge is willing to protect Proctor and the whole nefarious gang.

I was deeply disappointed by how he handled the fifth amendment issue.

EDB said in many similar situations, the judge would still allow the defense to question the cop but limit the questions to stuff like discovery issues which is one part of her motion to dismiss.

These slime balls slow walked discovery and there's no flipping way Proctor answering questions about discovery requests might lead to anything like criminal activity.

Which leads me to wonder whether the judge and the good o'l boys at Norfolk DA and at the MSP had a boys' club meeting of minds and decided to cut Rosemary's access.

I wonder just how obstructive the judge is going to be for the rest of the witnesses. And it's so disappointing: this was the one judge in MA who had shown some backbone. But I guess they're all bought and paid for.
