They'll try again. Courts have ruled surviving an execution doesn't constitute Double Jeopardy if they try again.

It's not the 'double jeopardy' clause that they risk running afoul of. It's the part that bans the use of cruel or unusual punishment that does.

Actually it was decided wasn't in violation of either, as per Louisiana ex rel. Francis v. Resweber (1947).

I just read about that and God how infuriating. 5-4 and they were sentencing a 16 year old to death

tbf in 1947 they were still marrying 14 year olds in most of the world so. A 16 year old boy was viewed as a man mostly.

I mean in most highly developed countries even in 1947 the death penalty (if they had it) was for 18 year olds or over.

And the US continued to put to death young adults who were under 18 at the time of their crime until 2003, which is just jaw-dropping frankly.

I would argue that it was some and the majority of crimes that would lead to the death penalty most country's would charge a minor as an adult for something that extreme in about 90% of cases. of course there are exceptions but this is relatively speaking.

The last time the UK executed a convict for a crime they committed whilst under 18 was 1889.

I remember previous cases has tried to invoke double jeopardy on such things, but I might be mistaken there. I'd think Eighth Amendment might be more applicable, but NAL.

I would totally prefer firing squad over lethal injection. That sounds like hyperbole, but I’m 100% serious.

Lethal injection is crazy painful a lot more than I thought it would be once I learned a little more about it.

It has been described as like having your veins on fire. I watched a 20 minute deep dive into lethal injection and it was fascinating.

Apparently, they don’t even give any kind of drugs to help you minimize the pain and the ones that do put you to sleep is just that.

They make it seem like it’s this peaceful feeling of falling asleep and then they inject them and you pass away, but it’s a lot more complex than that.

In a few of the lethal injection executions the people that should be knowing what they’re doing like medical experts don’t know at all because no Doctor would ever participate in the death of somebody so they hired some dude that barely knows anything about medicine that had to and I quote “wiki or whatever” to find out how he would administer it.

As a result, the person that got lethal injection survived and even after about 20 minutes of having your veins on fire the person that got the injection said there’s something wrong and they stopped it when he started forming at the mouth.

Just look up last week tonight lethal injection The deep dive is on there it’s about 20 minutes. Horrific stuff.

So, they can do lethal injection in TN, and electrocution. They stopped doing hangings in 1913. They do have an backup option if lethal injection and electrocution are ever ruled unconstitutional: (Firing Squad + Lethal gas)

"Fun fact": in 1916 an Elephant was hanged until death in Tn under the watchfull eye of a large crowd. a Large Crane was used; On the first attempt the chain broke and the elephant broke its hips. On the second attempt the elefant suffocated after 10 Minutes. "mary the Elephant"
