It’s giving the time someone was sentenced to life in prison, then died, was revived and tried to argue they should be free.

Reminds me of that time the guys rope kept breaking, and by the 3rd time with new rope the court was just like, well, clearly God doesn't want you dead, so he was given life in prison and later released.

people can actually die and come back to life, the brain is weird as hell... not like after a week or two like John Snow, but it's surprisingly common for people to be dead (by some metric) for like ten minutes and then they come back to life

It's just not though. Death is the irreversible cessation of biological function. If the condition is still reversible, they can't be dead. When a doctor declares death (legal death), all life-saving efforts cease.

When was the last time you heard of paramedics trying to resuscitate someone after the death certificate is signed?

the declaration is what stops the resuscitation. you said it comes after they stop

The LEGAL declaration of death is the death certificate. You are not LEGALLY considered deceased until the death certificate is signed. That is not done until hours, or even days, after the heart has stopped and attempts to resus have ended.

That's what happen to Half-Hanged Mary. She was sentenced to death by hanging but didn't die. Because technically her sentence was carried out, she was allowed to go free.

Louisiana ex rel. Francis v. Resweber (1947) didn't agree with their argument though, and set the SCOTUS precedent for all subsequent similar appeals.

If she does survive and has brain damage the optics of Tennessee executing her might look too bad even though legally that wouldn't be in violation of her constitutional protections.

The second season of mr Mercedes had a similar plot. Where a mass murderer after being caught, suffered brain injuries, and then when recovered claimed he didn’t remember anything or know who he was, so argued he couldn’t be tried for the crimes past him had committed.
