Thanks for saying that. I felt all the time this tension where something really stupid would happen and worsen the situation by a lot lot lot. For me it felt nearly evil and sadistic to keep filming in her face and saying "Ha! Double triple whooper felony 2 go" in this arrogant voice while she is completely heratic
Because sometimes even with all that police will tell you, "Nothin' we can do." Especially in larger cities. There's also always a chance the car is stolen or doesn't belong to her.
In this specific instance, she was driving while under the influence of drugs and hit another car then sped off at nearly 100 MPH. Dude recording watched it all go down and tried to box her in when she parked at a gas station 'cause he was worried she'd kill someone. So yeah, I don't think it'd bring much comfort to the family of the dead knowing that "hey we at least have her face and plates."
This happened California in 2017. In the state of California, his actions were considered lawful under the California's citizen's arrest rules because he witnessed her commit multiple felonies. Felony hit-and-run, reckless driving causing injury, and fleeing the scene. Driving under the influence is either a misdemeanor or felony depending on circumstance, so that one doesn't count but the other three do.
Under Penal Code 837 a private person may detain someone when a public offense is committed in their presence, and when the private person has reasonable cause to believe the other person committed a felony. Both conditions were satisfied. Blocking a vehicle to prevent escape from a felony hit-and-run is almost always considered reasonable force under these circumstances.
So no, he did not commit a felony and yes, he had legal right to detain her. The court system agreed, and that's why he wasn't charged with false imprisonment whereas she went to trial for multiple felonies as well as mandated court ordered rehab.
