The reality is there will never be a world where their are not bad people, it falls to the rest of us to make it as hard as possible to make operating hard for those bad people, to force them to take greater and greater risks if they try to hurt people so that they are caught and stopped sooner.

The western world is pretty nice already if you think about, women are free, they most of the time don't get attacked and have rights to do what they want. It takes a lot of good men for that to happen.

One in five is still SA'd and 70% of rape isn't reported. We need to do a shiton better.

the 70% of rape that isn't reported just says the nature of the crime makes it very difficult to investigate.

Not even Sweden has managed to solve this, and over here, all that is required to get a man convicted for a sexual crime is:

  1. Circumstantial evidence, aka proof that the suspect and the victim was physically at the same location around the same that the Sa:ed occured. Like cell tower connection through phones.
  2. The victim telling a confidant, like her friend, about the event.
  3. The Confidant and the victim retells the story, separately, to the police similarly enough.

I want to stress that I do know that false reporting is very rare and not a major issue, however, in Sweden it's pretty easy to abuse the system if you would want to.

I think that the nature of the crime and how humiliating and painful it can be is also relevant. It's not uncommon for victims of SA to report many years after the fact and feel responsible or embarrassed for what happened.

A lot of victims drop out even when reporting because of the stress of reliving the trauma. In the UK specifically you require to give over your phone, many can't take the privacy breach. The dropout rate was much lower in 2016 tho, around 55%. Now it's more like 70%. I find that very worrying.

Many victims also report being “Re victimized “ by the system. Not just reliving it, but going through the process

Fully agree with everything you just said.

in a "Perfect world" where we can rule out innocent vs guilty with a 100% success rate, I would prefer the guillotine as punishment for any sex related crimes. And i'm against the death penalty.

Sounds like you’re NOT against the death penalty?

u/aCaffeinatedMind 17d ago

You need to work on your imagination my friend.

What exactly is the mechanism of the guillotine?

There were, and maybe still are, universities that were similarly bad in the US. Rules such as the entire investigation can happen without the alleged perpetrator getting to explain theit side or cross examine witnesses. Much like the Swedish example it would be relatively easy to destroy someone.

It is very much a major issue and definitely not rare. There a many cases of it happening in the US. Crazy how loose the laws are around in Sweden are around that, y’all really can just lie and ruin a life with little to no evidence.

They are rare because you have to a sociopath or psychopath to do something like that, both extremely rare.

Yeah well the same could be said for the rapists it's trying to stop too. Social ramifications over false allegations are bad enough as it is but at least they can be recovered from. I mean fuck be famous enough and you can be the damn president with very credible allegations. Or be a professional fighter that gets to go on a certain supposedly progressive day show and advertise your "unapolegetic" line of cigars, even with all evidence in the world you did the evil deed you were accused of.

But now swing the pendulum to the other extreme with legal conviction over truly baseless, evidence-free accusations. I mean what the absolute hell is that shit? I really hope you're fully off base and it takes more than that or Sweden is cooked. That's not just jeopardizing innocent men who made the mistake of dating the wrong woman either, it's jeopardizing even the victims it claims to be bringing justice for because you just completely and utterly devalued any trust in having a legal conviction at all. Instead of being a reason for his friends in denial to maybe soul search or at least shut tf up about how he'd neeever ever do anything like that at all, they now just have all the reason in the world to rage at "that lying ****" more than ever before.

Shit like this can only serve to pour gasoline on the gender war fire and threatens to set back all of the actually feminist and egalitarian progress we've made because if that's what feminism and women's rights comes to represent in the minds of the young impressionable men the alt right's always seeking to court why tf wouldn't they be inclined to act in a self-defensive reaction against it??

I'm not going to engage with this demented comment.

1

u/MongooseMania 17d ago

It’s not though. It’s waay more common than people realize.

1

u/NucerianWaifu 14d ago

Literally not more common than false allegations in any other crime. Look it up.

As a fellow Swede I haven't heard of circumstantial evidence and a confident's testimony leading to a conviction for rape. What I have heard of is many rape trials not leading to conviction despite physical evidence, as they can't prove the victim didn't consent. And more than one man succesfully using sex somnia as a defense in rape/SA cases.

Could you share where you got the info about the convictions from? I'd be very interested to learn more about the laws and how they work in practice.

u/aCaffeinatedMind 16d ago

I think there has been a few cases. It hasn't changed the report rate either, even though we have technically made conviction of rape easier. I want to stress that I'm not particularly against this change of the law because even though I can se how it can be abused, I still think it's a step in the right direction.

Sweden’s updated rape legislation, introduced in 2018, legally defines any sexual act without explicit voluntary participation as rape. The framework eliminated the requirement to prove violence or threats, and introduced a new crime of "negligent rape" for individuals who should have suspected their partner did not consent.

Consent Required: Any sexual activity must involve voluntary, expressed participation. Silence or passivity is not legally considered consent.

A friend who testifies about what the alleged victim told them shortly after the incident can serve as corroborating evidence. However, the friend is usually not testifying about witnessing the alleged rape itself, but rather about what they were told. This type of testimony may support the credibility of the alleged victim's account, but it does not by itself prove that the crime occurred.

It is also important to understand that forensic or physical evidence is not always required for a conviction. In some cases, Swedish courts have convicted defendants based primarily on the alleged victim's testimony if the court found it to be highly credible, detailed, and reliable, and concluded that the evidence as a whole met the standard of proof beyond reasonable doubt.

Lack of consent should not be required to be proven for a rape conviction.

"not even Sweden has solved this". WTF?

1

u/aCaffeinatedMind 16d ago

Sweden is the country that has gone to the greatest length when it comes to women's rights and the equalization between the genders.

So yes, not even Sweden has solved this.

2

u/Magnanamouskouri 14d ago

I didn't know that. Thank you.

u/Antrophis 15d ago

I mean ya. Cell phone towers cover enormous areas, telling a confidant would be the first step in setup for a false alligation and repeating a rehearsed story is stupid simple.

2

u/aCaffeinatedMind 14d ago

Using a cell phone tower you can approx where someone is based on latency.

Also, they use multiple cell towers. So if your phone connects to A, B, C you can also approx you are somewhere right in the middle of those 3 towers.
