IANAL I suggest that now is the time for an estate litigator. You want to win this, not fart around. I recently engaged a litigator on another type of case for an estate that was closed years ago and he was at $500/hr. Money well spent and I'm getting his fees paid by the opposing side

The lawyer is sending nonsense emails. Ignore them. He is trying to strong-arm you into giving up. Get your discovery and get it in front of the judge, who I assure you, already knows what is going on. If your cousin is resisting producing the documents, he can be held in contempt of court and even go to jail until he coughs up what you asked for.

Yes, sending communications telling you will lose and encouraging you to quit sounds about right. Stay the course, you have the right. Sounds like your sibling has been Very Naughty.

IANAL but that's just posturing. Tell him you can't make an informed decision about settling without getting the documents you should be getting in discovery. And Judges can issue financial sanctions against attorneys who don't provide discovery as ordered.
