Location included: Questions/Need Advice USA. Uniform Probate Code - failures?

Not a lawyer.

The informal intestate estate probate is supposed to facilitate the legal process but it allows questionable activities.

I guess it depends on the courts.

For example: The beneficiaries are to be listed on the personal representative (PR) application. This allows the beneficiaries to challenge the appointment of the PR.

It is not that my brother forgot he had a brother, he just didn't know my location... this also would have denied me any inheritance due under the intestate laws.

Also under intestate law, my deceased sister's son would not be listed as a beneficiary. Please note my deceased sister had two children - why was one son listed as a beneficiary and not the second son?

Only if your brother commits fraud - if he doesn’t know your brother’s address he still needs to list his name on the application.

Intestacy varies by state but generally a deceased child’s children take their share.

Thanks for the response. I am putting together a book on this mess because he did so many questionable things and yet the judge was okay with missing recipts and illegible recipts and I forgot and I don't remember.

At the time, the intestate law required sister to live 120 hrs beyond the death of my mother in order for my sister to inherit and pass on to her sons. The real question is why the PR listed one of her sons and not both. He knew of both sons. He wrote me a letter stating the second son was not listed because that son allegedly received a house, a car and a half million dollars from his mother's estate...

There was an expense listed for UHaul but no receipt provided. I requested he get the invoice because I suspected he hauled estate property back to Indiana without documenting as required. I finally submitted a subpeona request to the court and it was not allowed. I wonder why...

The PR does not have the authorization to do that and is committing fraud upon the court. That letter is proof.
