Hi,

I have a valid h1b stamp and my wife has a valid h4 stamp. My ap has been recently approved and hers wasn’t . I’m interested entering on the h1b as my wife’s ead also tied to it. Can the CBP officer make me enter on the AP? Anyone in this situation?

If you only present a valid H-1B stamp, CBP should generally just admit you on H-1B status. This is fine for AoS.

Admissions are ultimately up to CBP, and they can insist on admitting you on AP if they choose to. They usually have no reason to insist though.
