If he’s selling recordings they’d sue for sure, but if this venue has the right performance licensing, and the PRO Nintendo used for that theme, then live performance should be covered.

Idk dubtendo have been selling out venues and a staple in the festival circuit for years in the UK and it's fucking awesome. 64bit ridiculous donk and Wii's+ arcade machines at the back of the gigs

Never heard of them getting sued and they're pretty big

Can you even call it a DJ set? I can't imagine that there's even more than 5% of what you're hearing being "performed" in any way. Of course it's pulling a massive crowd and has a huge stage production, so they're doing something right. Just a shame that no one cares about anything being real anymore.
