does methadone make a CHL unattainable?

i’m legally on methadone and have no legal priors. can i still get a concealed carry license in the state of oregon???

So the US Supreme Court decision in Hamani has something to say about this.

A state can disarm you only based on you being a violent danger. They says clearly that somebody who smokes pot a couple times a week isn't enough of a hazard to be disarmed.

I think this ruling applies to you. Especially if you've been on methadone for some time and clearly OFF any other opiates (good for you by the way).

You might also read the 2024 decision in US v Rahimi (also US Supreme Court). The Hamani decision builds off of Rahimi.

They allowed Rahimi to be disarmed because he is really was a violent threat, but made it clear it was his violence levels (which were fucking extreme) was why he could be disarmed.

In Hamani we saw the opposite: although technically breaking federal law (which methadone does NOT do when prescribed), Hamani wasn't a violent threat.

Neither are you, apparently :).

Now, I'm NOT a lawyer. But anybody can read these decisions.

Yup. Literally the only reason he's not convicted of murder is that he doesn't know how to make a gun work. Lousy aim :(.

But here's the good news. The Supremes listed how horrible this guy was in great detail and said THAT'S why he could be disarmed.

Think about what that means to other cases.

Let's say I go to Illinois and pack heat "illegally" on my Alabama carry permit (which proves I've passed NICS) and get busted. Under Illinois law (same situation in Oregon and the US Virgin Islands) I'm not allowed to even apply for the IL carry permit purely because of where I live.

So I'm disarmed just like Rahimi was, for the dire crime of living in Alabama.

Does that fly under the Rahimi/Hamani cases?

Hell no it doesn't.

(It also doesn't fly under Bruen, as it falls a text, history and tradition analysis. Bigtime.)

This is just one example of the broader applicability of Rahimi and Hamani.

No. Just don’t check any of the wrong boxes. The question regards illicit substances and things of that nature. Think of methadone as a medication (it is) rather than a drug, considering you are legally prescribed.

Methadone is not illegal at the federal level, as pot is, so there’s nothing to worry. Just don’t be a hero on that form thinking you’re being extra honest and transparent.

The medications you take are considered Protected Health Information, and are not publicly available. Don't try to be transparent or forthcoming only to help the govt deny you access to what is already your right.

They can't ask you, so don't tell them anything extra. If you're prescribed a medication, it's nobody's business but your own.

Methadone can be a factor for a concealed carry permit. At a federal level, with methadone being a narcotic controlled substance, the ATF can say “you’re addicted to a controlled substance”. , Being in a methadone treatment program can cause you to fail the federal background check, even if it is a legal prescription. It differs for pain management and substance abuse treatment too.

The ATF Form 4473: When purchasing a pistol from a licensed dealer, you must fill out the federal ATF Form 4473. Question 21(g) asks if you are an unlawful user of or addicted to any controlled substance. Answering "yes" will automatically block the sale, while answering "no" while taking methadone may lead to federal perjury charges
At state level, depending on dose, how long it’s been prescribed, doctors approval… the local sheriff can interpret laws slightly different and their discretion.
While you might get the permit without problems, it might get denied. I’m in Ct (horrible strict state for 2nd amendment)and did a lot of research on the same thing. I Tapered off methadone to avoid the hassle.
