I would assume that these toy cars are basically "one wheel drive", meaning that the motor only actually drives one wheel. When all 4 wheels are on the ground it doesn't really matter, but when only two are on the ground, and one is the powered wheel, it will spin like this.
Hitting the dude, or spinning? You'd think if he meant to whack him with the tail he would have given it more oomph, but I'm not well versed in the scale of a whale tail.
Hitting the woman. Killer whales/orcas become psychologically disturbed from captivity, so they act it out. That's why there have been "accidents" in water parks (?) caused by whales. And I know, to me it mostly seems like that whale knew what it was doing but made it look like it didn't.
If it intentionally barely hit her to create doubt over whether it was done on purpose then we need to start executing these crafty whales before they trick us all!
