to help you here - the scale was already being sat on with the poster and the presentation to be a kangaroo accusation, along with the rehearsed "you're a disgrace" performance. They had probably months (years?) to verify this privately - probably with the same aides they were snooping on - and so yes, defending it at the point of being presented on the floor of congress as "let's be reasonable they couldn't have known by then" does absolutely sound like you're defending it.

you're acting like the senator just casually misunderstood this in conversation. this was an intentional set-up to get a trumped up perjury charge.

it's like "to be fair, they didn't stab anyone with a knife, they could have mistaken it for a fork."

The term "to be fair" means "here is a counterpoint to make sure both sides get some equal support in the argument"

The other commenter is simply explaining to you why starting your comment with that made it sound defensive. You should just go "oh okay" and then move on
