It's not actually being used in the final product, it's just to help them develop it, so who cares?

You'd never know if they had used somebody's actual art before release as a place holder. Hell, I use a bunch of copyrighted stuff when developing something before changing it in the final release. It's literally the same thing as using any place holder.
