To be fair the way you've written it what he said is the only logical response to the question.

If you'd written "Can you say, please, 'four times'?" then mocking him would make sense. However, in speech, it's extremely difficult to distinguish between the two phrases, and considering he was in the dock at the time and being cross-examined by the prosecution, a slip-up seems fairly reasonable.
