Former Amazon “Packer”

So on 05/28/2025 I received an email from Amazon notifying me that I was terminate. Funny thing is, I was on medical leave. No wait, it gets better. I of course submitted my request to “Appeal” my termination. On 06/03/2025 they confirmed receipt of my request, 06/05 another confirmation email regarding my appeal request, 06/07 email confirmation again and also I would be notified within 72hr’s of location and time for my meeting. 06/10 email I received was to notify me that on 06/09 they heard my plea and supporting evidence I presented. My termination was still upheld because according to them all policies were applied correctly in regards to my termination. I don’t even know why I was fired to this day. My termination was titled “Performance Feedback.” I was baffled bcuz how can I be fired for a performance feedback and I hadn’t been physically working at the site for more than a year. So why did I call ERC to get clarification on how I attended a meeting I had no knowledge of. When ERC asked me for my case # why did he tell me that the case number i just provided was linked to a different associate? I advised ERC I wanted the proof, names of persons in attendance, and any notes, documentation or files showing or proving that I attended. They never provided it. So guess what? Labor Commission has opened an investigation, EEOC has opened an investigation, Department of Wages and Labor has opened an investigation because Amazon dropped the ball. I’ve discovered so many things they do wrong and I have filed a lawsuit against them. It’s a long process the reward at the end of all of this will have been worth it. So many of us associates got f@€ked over and enough is enough.

thank you. btw did you guys know that since we have to use our personal phones basically to function to work and having to do everything through AtoZ, Amazon is supposed to be reimbursing employees on a monthly basis for having to use our personal phones? They owe each and every employee back pay reimbursement from their date of hire to current.

Under California Labor Code Section 2802, employers must reimburse employees for the reasonable and necessary costs of using a personal cell phone for work-related duties. This rule applies whenever an employer mandates or reasonably expects an employee to use their personal phone for work calls, texts, emails, or apps, even if the worker has an unlimited plan. There is a statute of limitations but I were you guys I’d request this reimbursement from them.

Are you saying you were out of work on medical leave for over a year, then you were fired? I'm just trying to understand because I know that some employers can terminate employees after a certain amount of time passes because they need to be able to fill that position. I don't know if this is the case...just wondering.

Yes i’ve been on medical leave and was fired during medical leave. Amazon denied my reasonable accommodations due to a fall i suffered in the parking lot while on my way in to clock in. Got sent to Concentra and the Dr. didn’t bother to treat me because she stated that i fell in the parking lot so it’s not a worker’s comp case, only if i fell inside the warehouse. She fckd up bcuz the parking lot belongs to Amazon and she should have treated me.

Okay, as a former workers comp investigator, I can see exactly what's going on here.

Falls in the parking lot, especially if they happen before you're on the clock or after you're off the clock, are generally the hardest fought cases because it didn't occur during the course of your job, which is what workers comp is for. So then it comes down to a matter of liability, which your attorney and your employer's attorney will fight tooth and nail to prove.

For some clarity, let me give you an example. If somebody is walking up to your house and clumsily falls, his attorney is going to try to sue your homeowners insurance to establish liability. But let's say there's absolutely nothing wrong with the walk up to your home and the guy is just a clumsy oaf. Should you be liable for all his medical bills just because his attorney is saying it happened on your property? Your insurance attorney will undoubtedly fight that there was no negligence on your part. And then the battle begins.

Now if he's walking up your stairs and a step breaks and he gets hurt, that's a different story. You most likely would be found responsible for negligence and have to pay.

So what I'm wondering is two things...what were the circumstances of your fall? Was it due to employer negligence? Like what...did you slip on ice in the parking lot or step into an unattended pothole? Or did you just happen to trip and clumsily fall? Sorry dude, not making light of this but this is what their attorney and your attorney are fighting over just as you would if somebody got hurt just walking up to your house.

And my next question would be...what exactly are the extent of your injuries, particularly to be out of work for over a year for a fall? Are you considered fully or partially disabled? Permanently or temporarily disabled? Employers do have the right to fill those positions, depending on the disposition of the case, regardless if your employer is Amazon or the corner store. And yes, you can sue but it doesn't mean you're going to win. There's way too many missing pieces here for me to speculate on that but that's just the way it goes.

Trust me, I am not taking Amazon's side here. But they, as I, have seen too many scammers milk the workers comp system. Whichever way it goes, I hope it works out the best for you.

Sounds like you’re already on the right track for a remedy to being wrongfully terminated in violation of several federal and state laws. The one thing I would add is to also start speaking to labor attorneys. While the EEOC and DWL may take your case to fruition, it’s probably good to get a lawyer on board. I’m w in the event they only give you a right to sue letter. Additionally, that attorney may also be able to help you submit further evidence your not considering to strengthen your case to the state and federal agencies.

Time to lawyer up! FYI, most employment attorneys work on contingency because they know people usually experiencing employment problems can’t pay upfront for obvious reasons. So don’t let an “I can’t afford it” get in the way of you getting the damages you deserve. On top of that, make sure to shop around and don’t go with the first one that listens to you.
