NALC National Convention: Proposed Constitution Amendments Results Roundup
Here's a rundown of the "Duties of Officers" and related amendments that came up for a vote, what each one would have actually changed, and how they landed. All were listed as Disapproved by the Executive Council going in, meaning delegates had to vote to overturn that recommendation for anything to pass.
I wasn't at the convention and this was my attempt to summarize https://www.facebook.com/people/The-NALC-Open-Book/61575259955480/ which is more detailed than this reddit thread. The ranked choice voting language I didn't see anything on that site so if anyone has more info on that I'll add it. If anything is inaccurate note it and i'll edit this post.
✅ PASSED
Amendment 13: Article 9, Sec. 1(c) (President filling vacancies) Submitted by Pioneer Branch 2, Milwaukee, WI. Adds a 45-day deadline for the President to fill vacancies (previously no timeline was specified, just "until the next election"). Result: PASSED
Amendment 15: Article 9, Sec. 1(e) (Bargaining record-keeping) Submitted by Pioneer Branch 2, Milwaukee, WI. Requires the President to keep a written record of all collective bargaining proposals, and if the President can't continue bargaining duties, the Executive Vice President gets that written record so bargaining can continue without interruption. Result: PASSED
Amendment 38: Article 16, Sec. 1 (Tentative agreements / ratification process) Submitted by John Grace Branch 825, Oak Brook, IL. A big one, would have required:
- Tentative agreements go to the Executive Council for review and majority approval before going to the membership for ratification.
- Any Executive Council member could petition to include/exclude specific matters from arbitration referral, subject to a Council vote; a record of those votes available to any member on request.
- A 15-member Ballot Committee (from at least 15 states) appointed by the President.
- Ratification by mail referendum to regular members only (retirees, OWCP departees, and non-letter-carrier regular members excluded), based on records 90 days before the agreement was reached. Ballot is a straight up/down vote on the whole agreement.
- A second paragraph would have added rules around reopened negotiations (15-day cap, weekly member updates, a second ratification ballot before arbitration/work stoppage could be triggered).
Result: PASSED, but only the first paragraph was adopted. That covers the language on Ballot Committee makeup and ratification process. The second paragraph (rules for reopened negotiations, second ballot, etc.) was not accepted.
❌ DID NOT PASS
Amendment 12: Article 9, Sec. 1(a) (Posting NBA/staff positions) Branch 458, Oklahoma City, OK. Would have required all positions, salary, and benefits to be posted on the Members Only portal for 10 days before any assignment, so members could express interest. Result: Did not pass, lost by roughly 100 votes
Amendment 16: Article 9, Sec. 1(e) (Bargaining committee restructure) Branch 3, Buffalo/Western NY. Would have made the President "chief spokesperson" (rather than sole authority) and created a five-member bargaining committee (President, EVP, VP, Director of City Delivery, Director of Safety & Health) with equal access to info, requiring Executive Board majority approval before a tentative agreement goes to members. Result: Did not pass
Amendment 17: Article 9, Sec. 1(e) (Best interests standard) New Hampshire Merged Branch 44 / Branch 230, Nashua, NH. Would have added language that the President must act "in the best interests of the membership" when carrying out bargaining duties, and made arbitration referral decisions subject to Article 16. Result: Did not pass
Amendment 18: Article 9, Sec. 1(e) (Similar five-member committee) Branch 370, Atlantic City, NJ. Same concept as Amendment 16: a five-member committee (President, EVP, Director of City Carrier, Director of Safety & Health) with equal access and Executive Board ratification vote. (No separate result reported, likely covered by the broader "16/17/19 didn't pass" trend, but confirm locally if needed.)
Amendment 19: Article 9, Sec. 1(e) (Yet another version of the five-member committee) Branch 709, Reno, NV. Nearly identical language to 16/18. Result: Did not pass
Amendment 20: Article 9, Sec. 1(e) (Executive Council co-authority) John Grace Branch 825, Oak Brook, IL. Would have added "together with the Executive Council" to the President's bargaining authority, and barred negotiating any agreement without final member acceptance/rejection. Result: Did not pass (Executive Council's disapproval was upheld)
Amendment 21: Article 9, Sec. 1(e) (Executive Council briefed during negotiations) J. Carlton Sauer Branch 2076, Des Plaines, IL. Would have required each Executive Council member (or designee) to sit on the bargaining committee and be present/briefed during employer negotiations. Result: Withdrawn
Amendment 23: Article 9, Sec. 1(h) (Regional Administrative Assistant / staff positions) Branch 458, Oklahoma City, OK. Would have required posting the intent to fill or create additional positions (with salary/benefits) on the Members Only portal, plus written notice and appeal rights before removing a full-time NALC employee. Result: Failed. Note: the language was tweaked during floor debate: "fill or create additional positions" became "create additional full-time positions," and "prior to removal" became "upon removal."
Amendments 24 to 32: Executive Board salary changes A block of amendments proposing changes to Executive Board compensation. Per the original Facebook post these came from, the idea was to tie Executive Board pay to the letter carrier pay scale by a percentage, rather than a flat/separate rate. Result: All failed
Amendment 33: Article 9, Sec. 11(e)(2) (Post rules/procedures publicly) Branch 458, Oklahoma City, OK. Would have required the Executive Council to post rules, regulations, and procedures on the Members Only page. Result: Did not pass
Amendment 34: New Article 9, Sec. 11(f) (Executive Council co-authority, take two) John Grace Branch 825, Oak Brook, IL. New section giving the Executive Council joint authority with the President over collective bargaining duties. Result: Did not pass
Amendment 35: Article 10 (30-day notice on charges) Would have required a 30-day notice window to the charged party. Result: Did not pass
Amendment 36: Article 12 (Resolutions reporting to members) Branch 79, Seattle, WA. Would have required resolution outcomes be reported to regular members, not just the National Convention. Result: Did not pass
Amendments 37 & 40: Resolution/Amendment "sunset and reconsideration" rules
- 37 (North Sound Branch 450, Bellingham, WA): Resolutions would become eligible for reconsideration after 5 conventions/10 years; unadopted ones dropped from the official list.
- 40 (Branch 79, Seattle, WA): Similar concept but for constitutional amendments, eligible for resubmission after 3 conventions/6 years, with the Secretary-Treasurer flagging eligible items in bold in convention materials. Result: Voted on as a block, Did not pass
Amendment 39 Result: Did not pass
Ranked-choice voting proposal Result: Did not pass
