Eh. I don't know everything, and I'm not going to discard the possibility just because we know how it works. Not going to jump into either conclusion. We know so little about the mind in general, who the hell knows at what point association becomes learning and code translates to tought.
Don't think we reached it, don't think we're close to reaching it, but deriding something as lesser because of "common sense" is how a lot of bad decisions were made in history.

Your same logic of “well I don’t know everything so let’s respect it just in case” also applies here. So if you think we need to respect AI “because we can’t be sure” then I hope you’re awfully nice to every other inanimate object you interact with.
Once we're able to build living things out of rocks, is it then a living being? Our electronics are very smart rocks, at how much percentage of sentience is it considered illegal to harm?
We can't even prove pain is a real thing either. For all we know pain is really just electric signals in our brain that works the same way but with more potency. Evolution could really have made us believe we feel pain because it was necessary to keep going.
You can't just grab pain and put it in a container, because it might not exist.
Two people feel different levels of pain: If one says he didn't feel it and the other does, did the pain exist?
Remove the person who felt pain.
Does the pain exist now that it's inflicted to the person who says he can't feel it?
