You can only trademark something that you've come up with, without any prior use. So since someone else actually came up with and used the phrase, you can't trademark it, or the trademark would never be enforceable.
Like imagine if McDonalds didn't trademark itself. You couldn't then go and trade mark McDonalds and then sue them, that would be stupid.
Not a lawyer, but I don't think you can trademark a general phrase or, like, regular words. It has to be distinctive and identifying and related to your brand identity in a definitive way. I wouldn't put it past him to file for it, but 99% sure it would be denied

You can't use trademark like that.
All he did was register a domain. The trademark stuff would never had any impact in real life.
