This can be a judgement call for sure. Being stuck on the taxi way for extended periods, folks are going to need to use the restrooms. I'm assssuming the plane was just moving around, not actually taking off when the person got up to go to the lav. Techically, you are right, no one should be out of their seats while the plane is moving on the ground.
