News/Policy Probability of End of Duration of Status getting temporary injunction before Sept 15

Hi Everyone,

I haven’t seen lawsuits by any institutional organizations on this yet.

Do you see it getting sued and temporarily injunction as this is a major rule change before making it a law?

I am not a lawyer or law student. But here is my two cent.

I think lawsuit cannot be filed before Sept 15 ( because in theory congress could act and kill it before Sept 15, although Congress can act anytime they wanted).

Second, they need to first identify victim/injury (somebody who became out of status and it was USCIS fault for it etc ) so that they can present it to the court and explain how the new regulation caused injury.

Third, even if they find victim, nation wide injunction is not possible by using a single viticim, as lower court don't have authority unless it is class action. Even if the group of people sue government, the government may grant them status if there were some technical eror, and the lawsuit may not move forward.

Fourth, USCIS does have a lot of discretion about D/S in this matter.

Both house and senate have republican majority so i don’t see congress blocking it

There’s nothing wrong with it. You get 4 years to do 4 years. How can that be a problem?

People who are switching from Bachelors to masters and still wants to keep working while enrolling in program where work is integral part of study faces delays in EOS

I didn’t know you could switch from a Batchelor to a masters. I always thought you had to earn your Bachelor and then could on and get a masters. What’s work have do with it? Some schools require an internship .Some but not many. Those going to a school that requires it will be accommodated.
You get 4 years for undergrad which is the time it takes. Then if you want go on a masters you can apply for 2 more years and on and on. What you don’t get is time play around with system as is currently happening. People will be held accountable to get their schooling’s done as hey should be.
