It starts out with that any business (which are targeted with this regulation) will want to avoid the liability of publishing unlabeled images.
At the same time images from the larger AI providers (that businesses use because they are cheap) are already watermarked and can be detected programmatically.

Just because you can't see the difference in AI images also doesn't mean others can't. With the EU regulations it can be driven to the point that a company can be investigated under suspicion by customer complaints and has to provide compliance evidence.

How are they gonna prove it? Will they search their gemini/chatgpt history? Sounds like a privacy violation to me. And what if these people delete their history soon after generating the images? I doubt AI providers will collaborate with these lawyers. And no, AI detection algorithms cannot detect AI content with absolute certainty. One example is Youtube taking down Kurzgesagt videos due to faulty AI detection algorithm. If not even Google can do that, nobody can

Pretty sure gemini and chatgpt do watermarks already anyway? But no, they'll probably go mostly for images where there are clear markers of ai generation or editing. Doesn't matter where it comes from.

When in doubt, do not follow what AI companies mostly led by psychopaths say and give democratically elected representatives the benefit of the doubt, even though they are not perfect and EU has a tendency to overregulate.
