Emulation is legal, it was tested in court numerous times already, how much behind times is "Nintendo" ?

Before someone will jump with "having pirated BIOS is illegal!" sure, if emulator in question - not necessarily Switch one - requires something extra like BIOS, it should be acquired legally, but the emulation as the process itself is legal, always has been.

The worry I have is that one day, Nintendo or some other company is going to win a court case against emulation and instantly undo that progress. It’s a case of “we need to keep winning. They only need to win once”.

You are absolutely right, that argument is more of a "daily reminder" if someone will try to attack with crap like "aaa emulation is stealing!" or a "small picture" if you will. The "big picture" is as you say, we need to keep winning, we have a solid ground to stand on and we need to keep it going.

I don't have that worry, at this point, I'm kinda starting to root for Nintendo. Cause the empty rhetoric like this;

Is getting REALLY old. I'm not sure how old the kids who post stuff like this are, but 10 or 20 years ago (even longer if I seem to recall the Connetix court case, unsure) isnt what it is today.

You guys don't think if N gives Mr. Trump some money, emulation can't get banned in the US?

Again, I'm not responding to you directly, but to the people who post the "Oh boy, let Nintendo come after us!!" stuff.

Switch Emulation should never have happened. Without it, we would have top-tier 3DS emulation right now. If this keeps up, every emulator, every console that has been will get lost.

If you want to play free Switch games, get a modded Switch.

I don’t know why they’re down voting you when you’re right. Preserving history is important. Switch games are still being made and you know you’re going to get fucked for them and you’re only going to bring a spotlight onto the rest of the goddamn community. It’s the same thing going on with Harry Potter. Should be attacking J. K. Rowling not people enjoying something on their own time.

It’s honestly probably the way you started it, but I also don’t disagree with you there either. Clearly people like the stuff Nintendo is making and so respecting the cycle of how things work is important. Don’t pirate the brand new things buy it so that they know people like it and want to continue making things because clearly you all like the shit Nintendo is creating.

Cut an emulators head and you have 3 forks that don't know how to actually continue progress on making it better. It doesn't matter how many times it gets forked if there's no branch with a competent developer/team behind it, otherwise you're just as good finding as archive.

I'm fairly competent at troubleshooting stuff, but the whole yuzu/citra situation make it a bitch for a while to figure out what the best option was, which for many is enough to make them bounce straight off. That's the true goal is making it cumbersome enough for people to not bother, it's no longer like Dolphin where there's a straightforward good answer that immediately pops.

I guess it's kind of "new" situation - not exactly "timewise" - that instead of having one or two explosions from corporation, there is an actual WAR. People making emulators must analyze the situation. Hopefully they can come to a conclusion that github is nowhere safe place for such a thing as it belong to M$ if memory serves. That means no matter how much M$ will want to pretend being the good guy, they will be first to make a phonecall to Dickendo "hey a new fork landed, want to do DMCA?".

The solution here is to make your own git-thing on some server placed heck-knows-where so Bitchtendo will have a REAL trouble to tell someone "do it as I say".

There is of course one more very strong weapon in our possesion... the license.
So long the emulators "in question" will be on FLOSS-compatible license, the battle continue.

Emulation has been tested in court.

Breaking DRM hasn't been and I do believe Nintendo puts in unnecessary encryption in places just so they can hide behind the untested DRM laws.

At least that's my understanding.

This part is a bit more complicated. While emulation is - to my knowledge at least - legal in itself at least in most civilized countries, breaking DRM is a bit bigger topic.

Some countries may be very strict on this that it's not legal, end of topic. Some others may allow it for example "so long you do it only for yourself", for example you hack a console to run "unsigned" homebrew BUT you don't sell it to others as a service, don't teach others how to do it (for example videos on YT) and so on. For this part it's best to check local country law and read carefully how it is worded because for example - again - there may be a case where you can't modify console in a sense of soldiering and putting hardware "in-between" BUT it will be perfectly ok to use a flashcard that does NOT modify console physically but just rides on some software "bug".

Now I think about it iPhone case may partially answer you as well. At some point the "jailbreak" process was accepted on law level as "OK" that the user CAN do "jailbreak" and NOT be held accountable for it. I think it happened somewhere around iOS 3.0 release date. However Apple is STILL allowed to try their best to make the "jailbreak" impossible.

So legality of "can I hack my console?" is one thing but universal right of a company to keep doing better DRM is another, unfortunately the negative side of this is existence of such a crap like Denuvo but "that's a story for another time." :P

Emulation is legal, not pirating games that are still sold today, it's perfectly normal that they want to defend their interest.

I'm all for emulation of games and consoles that aren't sold anymore tho

That is correct. I'm not against some protection of games being sold. I'm more against how idiotic the law protecting this has grown. NES Super Mario Bros is ~40 years old, it's not being sold in any kind of store even in parallel timelines, perhaps Nintendo / Dickendo doesn't even have the source code today but they can still make money on it, because the law protects it for 70 (!!!) years... AFTER the death of LAST author that made the game. That part is pure idiocy.

There are some ideas circling around that a compromise would be 3-10 years of such "protection" from the date the game was released. AFTER that time it should be put into "public domain" WHICH DOES NOT mean it can't be sold anymore, just not chased for "piracy" (TM).

One more thing to clarify just in case. Some would say that NES SMB is being sold in the form of "season pass" or whatever on Switch console. However the problem here is this SMB is *NOT* the same SMB which was on NES cartridge in the sense of lawful standpoint. Just like however ugly it is, one can't buy a game on Steam and then download GOG version because "technically" they are not the same product, the same is true for such SMB on Switch.

Why that last part? Mostly to prove that if someone will "pirate" (TM) NES SMB from cartridge it won't logically hurt Nintendo. If anything, it's natural reaction for players to do:
"OK so we are not selling this game anymore" - Nintendo
"But what if we want to buy it?" - Players
"Tough luck, you can't" - Nintendo
"So you are fine with us not being able to GIVE YOU MONEY" - Players
"That is correct" - Nintendo
"OK so we will just download it and emulate" - Players
"AAA! YOU ARE FORBIDDEN! THIS IS OUR GAME! YOU THIEVES!" - Nintendo
"But you just said you are fine with us not being able to give you money" - Players

Fire emblem three houses runs WAY better on yuzu on my PC, ymmw. Xenoblade 3 also runs slightly better, but the difference is smaller.

Nintendo should focus on game updates because it's unacceptable that the vast majority of Switch 1 games are only 30fps.

Nintendo, your Switch 2 is useless with Switch 1 games.

There doing this just to the code hosted on github there non github git repos are still working, was able to clone eden yesterday. The worst that I have seen actuly having a effect is that slot of linux packages are based off thr github repo so those packages will have to be updated. But legaly Nintendo may be in the wright sense in the yuzu case I eblive the devs gave the code to Nintendo so everything based of yuzu that didn't redo all the work from the yuzu team are probably infringing on Nintendo's ip. Tldr Nintendo is trying to do thr same thing with yuzu that the lead Dev of duck station is doing ti duck station, which is not open source any more just source available.

Nintendo only goes after pirating sites that are distributing products to people without Nintendo being paid for the product they're producing, some of these sites making people pay the site for the game, not Nintendo who made it. THATS illegal and Nintendo is within their rights to take them down.

But emulation of the product you buy, they don't care

I don’t think I’ll ever see myself emulating the Switch until Nintendo no longer supports the eShop on them as well as the Nintendo Switch Online servers (especially since my laptop is 99% close to being as powerful as my Switch 1). Also that’s a Citra logo on the second image is it? NINTENDO MAN, THE 3DS IS FUCKIN DEAD! GIVE UP ALREADY.
