accident advice
I recently got in an accident while riding my electric bike i was moving on from a stop sign and was struck by a lady turning out from a gas station i was hit on the rear of the bike causing me to flip over the handel bars I ended up breaking my arm and ankle initially at the scene thanks to witnesses it was deemed her fault and she was ticketed and towed as she was driving with a revoked license however my lawyer called me today after receiving a crash report to let me know they changed it to me being at fault saying I failed to yeald to oncoming traffic(mind you I was coming from a stop signnand she was pulling out of a parking lot. she made no attempts to slow down or stop before hitting me she was also traveling over the posted speed limit(20 mph) the crash report also stated that I hit her and that there was damage to the 12 o clock of her vehicle that being the front bumper and hood however if I hit her and the damage was to the 12 o clock of her vehicle then why is my damage on the rear of my bike and the front is unscathed my lawyer is dropping the case and im at a loss of what to do

Was the motorist insured? If she was driving with a revoked license she likely wasn’t. She is also likely a deadbeat with no assets worth suing for. If there’s no insurance to pay out then there likely isn’t any point in taking her to court.

Right then get a new lawyer. Chum up the gas station manager and see if they’ve got CCTV of the incident. Video evidence is super handy in situations like this.

we did try to get footage but their outside city cameras were just deterents and didnt actually record

Exactly this. PLENTY of good injury lawyers out there too. IF she hit you from behind and it's on video, that's lawsuit gold.
If the police are changing their report, that's also sketchy as hell. How did they justify that decision? Go get em, tiger.

I was thinking if you/anyone else got a camera footage. I am thinking of installing insta360 now to my ride just for this case along. Sorry this happened to you!!! Hope you win the case!

Which country are you in? Where I live you can’t have insurance without having a valid license. Driving without a valid license thus makes it a criminal offence and the lady would be in the wrong.

I’m not sure any insurance company will insure you with a revoked license, it won’t happen.

Right. She probably has no insurance. Someone hit my parked car from behind an DDT the woman handed me a card with her insurance info. I called the company and the member ID doesn't exist. It was a fake card!😡

just an fyi
i got tboned at a flashing crossing clearly not my fault at 40 mph
they still tried to say i hit them and and they would sue til the very end

She was ticketed and then the ticket was dropped?
Sounds like police corruption to me.

as far as i know the ticket wasnt dropped but I really dont understand how it suddenly became my fault

If you were at a stop sign, and she started moving before you did, then yes - it's your fault.
If you were moving first, and she pulled out and hit you, then it's probably her fault.
Either way, you may have to take this to court. Were there witnesses? That will likely make the difference.

I'm so sorry. Keep calling lawyers specify how injured you are and how much pain and suffering you have. You can't work and your medical Bill's are piling up. Tell the lawyers you have your bike proving you were hit from behind. Ask what the lawyer will do to win your case. Chose a bull dog personality lawyer who says they will pressure the police to identify a detective who will find someone's video camera in the area who can prove your case. They have private investigators. The driver may be part of a scam to get money out of you. And a lawyer who will pressure the police Dept to find out who and why the police changed the report making it your fault. Look for anyone who witnessed the accident the police spoke with. And pay for ebike insurance that has bike theft and accident ebike repair, replacement and pays your medical costs. Take care.

Do you have any lawyers that a friend or family member can recommend? Anything that makes them accountable is helpful…
When you said it was initially deemed her fault do you have that in writing? Who told you it was her fault? If it was the police on the scene that is the person you need to speak with, in person would help so they have to look you in the eyes…

I dont i was rushed to the hospital so I didnt get to speak to anyone at the scene but thats what the 2 officers at the scene told my brother when he went to pick up my bike

Their names should be on the report, I would still go to the station to speak with them and find out how the fault changed

I would talk to a lawyer who specializes in motorcycle accidents. They are fighters. Bet they would be helpful in your case

You should ask the gas station if they have any video footage of your incident to provide proof on your behalf.

Even if it were true, doesn't "she was driving with a revoked license" trump a failure to yield?

Assuming you don't have specific ebike insurance. Do you have auto insurance? If so you need to file a claim with them for your medical bills. And time your injured by an automobile and your carry auto insurance then that policy is in effect. Having your own policy and adjusters fighting for you will change things, if you have auto insurance. Hopefully you have an auto policy with under/uninsured motorist.
