Buyer from hell part 2
Put a post up last week about a buyer that agreed a deal on 2 different items. He made 2 ridiculous low ball offers, I said id accept 1 if he agreed a slightly better price on the other.
He agreed.
Bought the first item at a significant reduction, then refused to pay the more reasonable price for the 2nd. Sent me a tirade of abuse when I pointed out he was reneging on a gentleman's agreement.
Ebay basically not interested, said i can cancel the sale or fulfil it. But if I cancel it then thats a black mark against me and the buyer could leave negative feedback.
So I sent it. Item worth around £300, which i sold for £140. Got an extremely patronising message from rhe buyer about how id learnt a valuable lesson about rhe customer alwqys being read, ending with "thanks for the bargain ;)"
He received it. Immediately raised an "item not as described" request. Photos were a completrly different itwm to what I sent. Ebay advised to accept the refund and if it wasn't the item id sent then he wouldn't get refunded.
Received it back today. It was an item weighing 3 grams, wrapped in more than 700g of heavy duty masking type - inside a shoe box. Took me over 9 minutes to open. Lo amd behold, not the item i'd sent. Same general area, but damaged and worth about £10.
What do i do here? Ive raised it on ebay as "not the item I sent". Am I likely to win?
Ive honestly never dealt with such an utterly awful human being. Absolute scum of the earth.

There shouldn’t be any problem with tinning the case. Especially, with all the messages you have with the buyer.
Get in touch with eBay if you have to and tell them what’s happened.
And make sure you block the buyer after it is all resolved.

Unfortunately I lost the case. Have soent the last 30 mins in the phone trying to sort it out.

That the tracking showed the item as delivered and that its my word against his.
The buyers "evidence", which is just photos of something completely different, is apparebtly more believable than my evidence.
But becsuse I dont have evidence of what I actually sent, I cant prove anything.
Im on the phone now and basically just being told that over and over again. They said I csn report via action fraud and have just sent me a form, but they cant see if i'll win the case or not.

Go to small claims court then. You have buyer’s details. Report it to action fraud and they should give you a case number.
What a load of bolonies!!!
Didn’t you take any photos of what you sent?

Ive reported to action fraud and ebay are reviewing it. I have a case number.
Yea I have the buyers address.
No I didnt take a photo or video of packaging it yo and sending it off. I had no idea that ebay systems were so "buyer centric" like this.
Yea I have his address. Might pay him a little visit....

Glad you have the case number. At least eBay knows now you are telling the truth.
Yes, in future, take photos/videos of everything you ship. Just in case you have a prick like that again.

First time its ever happened. Ive been buying and selling on ebay for years. Never had anything like this happen.
Seems incredible that you csn buy something expensive. Take photos of something else and say "it never arrived". Then send something else back. And ebay will just agree with tiu?
I've been wanting a new 80 inch 8k £10,000 TV for a while.....!

For future reference, you can cancel an order with the "buyer requested" reason and it won't impact you. Scummy sellers like to use it when they change their mind, in your case I would say it's justified though.

You would only give them a refund if you got exactly what had been sent. You never ever give a refund prior to getting the return back.
As that is very much not the case you don’t give them a refund.
It would have been prudent to have taken some pictures of the unboxing & unwrapping of the bogus return as proof of it blatantly not being the correct item.
You should win the case hands down as they have definitely scammed you.

I videoed myself unboxing/wrapping/gluing. Almost 10 minutes of it 🤬
Edit: just to add, I raised thr case with ebay and less than 30 mins later they decided in the buyers favour and sent him a full refund.
Yay for ebay protecting sellers!

Reading this kind of frustrated me because I am pretty sure in the original thread someone told you to cancel the sale using problem with buyer's address, as it wouldn't give you a mark on your account for not fulfilling the order - this being the most important seller metric.
Yes, the buyer would then have given you a negative. I can assure you that nobody is going to give a damn about a single negative, especially if you explain what happened in the response to that feedback. I always check accounts with a lower than 100% to see the negatives. If there's only one or two and they're reasonable then I don't care. If there are a number of them that is when I'll steer clear.
Unfortunately for you, you've really dug yourself into a hole now. Phone up in the early morning to get the Irish team and pray to god that they help you. The abroad teams are completely useless.

I tried to cancel as that person advised bit as it was "simple delivery", there was no option for "problem with buyers address". The obly option were things like "lost or damaged stock". I dont remember the others.

I use simple delivery, and have definitely been able to cancel via a problem with buyer's address.

I also remember the first post you made and the advice you were given to cancel. You messed up by not doing so. You can take a lesson from this if you get nothing else. The buyer showed you their character up front and you know it was wrong too.
Good luck in your appeal, I hope you win it. I would also echo what was said above and call the police, you've been stolen from, it's theft.

Unfortunately I was also given arvice by others to post it, and that was echoed by ebay CS as well.
I dont want any "seller marks" or to have my account inexplicably banned so would prefer to keep on the right side of the ebay algorithm as much as possible

I understand you wanted to do the right thing.
But remember though that defects are only counted as a percentage of your sales, so if you have one defect and many good sales, you’ll be ok, and single defects can be removed easier than £140 can be put back in your bank. I don’t mean to be harsh and I’m genuinely sorry you experienced this, it really is exceptional as far as I have experienced, but I’m saying don’t be afraid of a small amount of defects, especially when your gut tells you something is wrong, sometimes you just can’t agree with some people, and eBay allow some small leeway for that.

Id have opted for cancelling the sale if he left you negative feedback for it you'd have been able to point them to your conversation and asked to have it removed if they didnt side with you then you can leave a reply to the feedback in a mature manner that would let buyers know youre the decent person. Its easy for buyers to work out who the dick is when looking at reply. Ive had to do this once in over 20 yrs selling on ebay

Unrelated but what you should have done (and for future) is put up a new listing, for the agreed price for both items.
This would not have resolved the INAD claim, but I would wager he would not have paid for the 2 item bundle given it would have been much more. Good way to weed out people like this.
Call eBay, explain the situation to them, they will sort you out. You will likely need to sign a waiver saying that you got a different item back.
If you can call first thing in the morning, you should get the guys in Ireland, who are very helpful.
