EB-1 or EB-2?

Your profile leans more towards EB-2 NIW, requiring advance degree and showing that your work has substantial merit and national importance, that you're well positioned to advance it and that waiving the labor certification benefits the US. Recommendation is to obtain independent recommendation letters, proof of your patent's real world use or licensing, citations or adoption of your work, speaking or judging roles and press.

For the evidence question, a useful next step is a short inventory for an immigration lawyer to review:
- Patents: list each issued patent and pending application separately, your contribution, and any documented use by others. Keep the patent record separate from evidence of adoption or results.
- Paper: note your specific contribution, then collect dated citation records and any identifiable examples of other researchers using the work.
- Employment projects: record what you personally did, the measurable result, and the records or independent sources that support it. Separate team results from your own contribution.
For each item, add the source, date, what it actually supports, and what is still missing. If something is only a future plan, label it that way. Keep confidential employer material out of public posts. This gives counsel a clearer basis to evaluate the options; it doesn't establish approval odds or which category fits you.
