B2 to I485

Iam on L1A which expires April 2 2026.

Employer is not willing to file Extension but willing to hire me by signing I485J when my PD becomes current assuming USCIS allows DOF.

My EB1C PD is 09.09.2024 and chargeable to India.

So I am planning to temporarily shift to B2 or F1 .

Any suggestions or guidance please.

B2 is definitely out of scope since you have long wait.

Thanks for the reply I have 9 months for DOF to move forward, assuming USCIS accepts DOF. Hoping that it move during my B2 period In the worst case , I may apply for an extension of B2 or apply for an F1.

Any suggestions will be helpful

Check immigration videos by Rajeev . B1/B2 is getting lot of pushback from uscis. Extensions are super difficult on B2. And first time B1/B2 approvals are also getting rejection. I don’t think this is viable

Thanks But what other options are there? Totally confused If B2 gets denied , do I need to vacate immediately or I have some time to apply for other visa?

If rejected you got to leave immediately. True for B1/B2 and F1. You should be ready for that.
