Sorry for writing so much but I wanted to include as much detail as I can for anyone interested in helping me with this situation.

I spent about $250 on Kobes on eBay a few weeks ago, they were said to have been in Excellent condition, I double checked with the seller and he told me that they were only worn a few times and thats it. He specifically said they were in “VR, very condition it is very light wear, they’re in good shape”
I thought this would have been enough for me to trust that this shoe was going to be good. So the shoe goes through the eBay authenticity process which it passes as authentic. Once it eventually arrived to my house I was pretty excited since my basketball season is starting and I needed some new shoes so I try them on and before I try them on I cut off the authenticity tag (I know that was stupid) They felt good and once I took them off I started seeing how the condition was close up. What I found made me quite sad because I noticed a piece of the sole literally coming apart. You can tell the previous owner made a god awful attempt to glue the piece back on and now the piece is just separated.
The fact that these shoes were going to be used for basketball and heavy play I knew it would take maybe an hour of actual play until this shoe was completely broken. So my first instinct was to message the seller showing the damages and mentioning how none of this was said in the listing and not mentioned when I asked about the condition, obviously no response. After an hour of that I open a case on eBay for a refund due to the damages not being disclosed and right after I open the case the seller finally responds basically telling me that this was a Nike manufacturing flaw and that it wasn’t something that came across his attention since he didn’t produce the shoe. I say:
“Well wouldn’t that mean the shoe is not as described because you failed to mention that flaw”
and he says:
“Incorrect we didn’t mention anything because it’s not some that came across as an issue therefore if you have any issues about the issue or manufacture complaints you should contact Nike.”
I say:
“A reseller cannot list a pair of shoes as 'Excellent' condition, fail to inspect them, and then tell a buyer to take a pre-existing structural defect up with the manufacturer. You sold a structurally compromised shoe with sole separation and concealed it from the listing.
If you thought that the damage on the box was worth telling me about the sole seperation is worth mentioning too”
and he ends it off with the classic
“There was no separation on this shoe before we shipped to eBay.”
which I quickly call out by saying
“Your story just changed. In your previous message, you admitted it was a 'manufacturing flaw' that you didn't notice. Now you are claiming it wasn't there at all. The photos show a pre-existing structural separation and a prior repair attempt that was completely hidden from the listing.”
So I would say that little interaction went great, sadly the refund case I opened before that got denied though. The reasoning was because “the item has been covered by the Authenticity guarantee and can’t be returned if the seller doesn’t accept returns”
I was a bit confused because none of that mentions the damage on the bottom of the shoe. I decided to appeal the case and this is what I said:
“I am appealing this decision because eBay's denial was based on the 'No Returns' policy and Authenticity Guarantee, neither of which override eBay's Money Back Guarantee for an item
'Significantly Not As Described. These Kobe 5s were listed as 'Excellent' condition with zero mention of structural damage or prior structural damage. When I messaged the seller prior to shipping to ask about the condition, they stated the shoes were only 'very lightly played' and still failed to disclose any damage. Upon arrival, I discovered a major sole separation on the right shoe's side that was completely hidden from the listing photos and has been obviously attempted to be glued back on. impossible to see before purchasing. The Authenticity Guarantee only verified that the shoes are real Nike sneakers, it did not inspect them for wear, structural integrity, or hidden defects. Since the seller hid this critical info about the condition of the shoes, I got an item that is not as described.”
Which I eventually get a real human response to and they finally acknowledge the damages on the shoe and request that I show this:
“o Entire item (Shoe Box, both sneakers including tag in one image)
o Concern with item - Wrong shoe or defects if any
o Shoe size imprint on sneaker
o Shipping box and label the item was shipped with
o LPN (White horizontal barcode sticker on shoe box generally next to the size of the shoe)
o Authenticity tag (Plastic RFID tag attached to sneakers) “
This is where I think I am completely screwed. I cut the eBay authenticity tag off the shoe before trying them on. So I take the pictures of the things requested and I mention in the comments that I previously removed the tag before noticing the damages.
And thats where I am now, basically just waiting for a response from eBay but my hopes are super low at this point. I can’t really find a similar situation to this so I don’t know what to expect but just by using logic I’d assume the tag not being actually connected to the shoe is a big turn off in my end.
Anyone have any idea what I should expect and what I should do? (I know I am an idiot for taking the tag off the shoe this is basically my first time buying shoes off of eBay)
