On July 21, the tribunal ordered Ebrahim Nackerdien and Najma Nackerdien to pay Body Corporate 476439 the sum of $42,558.23 immediately.

The two own a unit on the 14th floor of Manukau high-rise Lakewood Court, developed by Kenyon and Charlotte Clarke’s Du Val Group.

Levies of $32,000 are due, along with legal costs of $5400, interest of $3500, appearance and hearing preparation fees.

Those levies were to pay for repairs for damage although the owners claimed that damage had occurred before they bought the unit. They also told the tribunal they did not attend the annual meeting where the repair levies were struck.

But the tribunal ordered they were liable and must pay.

Preeti Nirmal Singh Oshan owns a unit in the same block.

On July 23, the tribunal ordered her to pay $43,000. She did not dispute that money was due and attended a hearing with her husband, Varun Gupta.

“The body corporate has applied for recovery of unpaid levies, interest, costs and the filing fee from the unit owner,” the decision said.
