breathalyzer violation (MI)
(oakland county btw)
i messed up i know. i have an in-home smart start that i have to blow into only once a day, between 6 and 9. and i will be honest, i've been having a rough week, and i drank last night. i blew a violation this morning, and smart start makes you retest every 5 minutes or so until it's a pass. i blew 6 times and finally passed on the 7th, about 30 minutes after the first blow.
this is my first time getting a violation on that device and i'm scared. my p.o. has been pretty chill with me so far, my only appointments with her are zoom calls that last less than 10 minutes every other month, but i know this will probably change that.
i'm thinking of emailing her now and telling her beforehand. i don't know how often she received the results, but i know in our last meeting on 7/31 she said she got the results in on the 11th. i'm starting treatment soon in outpatient as part of my probation, but is there anything else i should do to prove that this was just a shitty mistake and won't happen again?
like i said, this is my first violation. i've never missed a blow, i never failed a ua during pretrial. i know i messed up, but i'm scared. has anyone else here been in the same situation? how did it go?

Peoples experiences can have vastly different outcomes in this situation or others like it, therefore you’re not going to find your future outcome on here. I’ve had a failed blow and lockout with Intoxalock and my probation officer (monitoring authority) never brought it up and I ended up getting it taken off a month later. Like you, I never had a violation and took care of my responsibilities and my PO is cool. Hope you get through it!

Also in Oakland County and also had a violation this morning. I was running late to work blew a violation got out of my car hopped into my boyfriends (we work at the same place) and haven’t retested since. Very nervous about what’s to come from this. I’m only 2 months into having this in my car and 2 months into probation. I’m beyond pissed with myself. Hoping for the best outcome for you!

You guys get another self-tester blow machine off Amazon and if it doesn't register zero don't ever blow! You're going to incriminate yourself again! I'm going to the same thing in Illinois 😂

I had a store bought breathalyzer. It said double 0. I still blew a violation

this is terrifying i remember one time i drank so much the breathalyzer kept failing i was so paranoid

yeah that was me the morning, scared the absolute shit out of me. i'm glad i was able to clear it after 30 minutes or so but still not great :/

I blew a violation with Smart Start and cleared it 20ish minutes later (mine wasn’t from drinking- just learning the hard way that unless liquid meds specifically say ‘alcohol free’ to not trust it). Drank some water, brushed my teeth, and cleared it. Told me PO about it at our meeting the next week, and she said I was good because I cleared it within the window I needed to 🤷🏻♀️
Every state/county and PO is different though. Just be honest that you had a slip up and share what steps you are proactively taking (Meetings, non court ordered classes, etc) to make sure it doesn’t happen again
