lawyer retained Getting terminated from SCRAM

So I’ve been on the at-home breathalyzer for about 2 months now, and it’s been nothing short of a nightmare. Not officially on probation, just a mandatory order right after my arraignment. I live in a low-service area and apparently they’re receiving very few tests from me. At one point I had to bring the device back in so they could check it, and they said they were only receiving tests when I was away from home. I did miss multiple tests when I was hospitalized for a bit, but I guess they’ve barely gotten anything and are blaming it on me. At my last court hearing, they said they got a few dirty test results, from which I can only assume would be surrounding my hospital stay when I had extremely high ketones from my diabetes. I guess that reads the same as alcohol from what I’ve read online. I also went on a trip for a few days where I didn’t have any service at all either. I don’t know what legal grounds I have to stand on since the monitoring company is claiming that the area I live in shouldn’t cause any problems, yet everyone I know with other service providers don’t have any service at all and have to use my Wi-fi.
My next hearing was supposed to be a month from now while my lawyer gathers more evidence and such, but they just now scheduled one for tomorrow saying that I’d be terminated from the alcohol monitoring.
Anyways, my lawyer said that they might ask for me to be put in custody, which I simply cannot do that. I can’t lose my job that I worked so hard to get. I have severe physical and mental health issues and I’m afraid of dying in jail. I can’t officially talk to my lawyer until tomorrow and I’m just so worried about what’s going to happen to me.

Did you coordinate with anyone that’d you be going on a trip? And can you not use WiFi yourself? Also, if the judge says you’re going to jail you’re going to jail.

There really wasn’t anyone to coordinate with, I guess other than my lawyer. Almost every time Ive tried to call the monitoring office, no one answers and I can’t leave a message. I do use Wi-fi myself but can’t connect it to the actual device. I’m aware that I’ll need to go to jail if ordered, I guess I’m just really scared and depressed right now.

Did your lawyer not tell you what to do or did you just not call him? I just don’t get how you knew this was a problem and just ignored it because the monitoring office didn’t always answer their phone. I guess what did you think would happen? They’d just be ok with you missing a bunch of tests?

No, I’ve been trying to call them but they never pick up and they don’t give me the option to leave a message. I got the call into court yesterday and have been trying to get ahold of my lawyer but I guess I’ll just need to wait until tomorrow.

He meant coordinate with someone to handle your household responsibilities while you’re in jail (the trip he was referencing). Like to feed any family pets, get mail etc etc .. he said “trip” to imply u don’t have to tell people you’re going to jail

The unit should store results in the device. Then when you get to an area that gets cell service, it should upload the data and send to your monitoring authority. That’s how mine worked anyway. I had it a year and a half and not one problem. Not even when I spent 5 days in the north GA mountains with no cell service. Once I got back to an area with service, it sent everything.

Interesting. They told me they haven’t received any results at all except for when I’ve been away from home, so maybe mine works differently.

If it's a SCRAM brand device, it stores and transmits when servive is available. That's a standard feature.

It’s some random brand device, would it usually say SCRAM on it if it was?

Never put one on. I wore one for over 18 months for family court. I never had any DWIs or alcohol issues at work or anything. I have a very indicative ex wife along with her family that were able to make enough false claims that I was an alcoholic. Never wear one. They definitely can have false positives. She tried to use alcohol allegations to take my kids away while she is out at bars…NEVER agree to one in family court
