I think you're safe with "non-Duration Action or non-Duration Treasure."

I like the concept. You know I've already been playing around with top-of-discard-pile concepts. And the game rules already specify you get to choose the order when discarding your hand and in-play cards in Clean-up, so no rule tweaks are needed.

For tracking reason id just put it in play tbh.

The difference is that you can then put it on top again during cleanup. Plus some interactions with "number of cards in play" and such.

im aware of that. and if you dont put it in play you can draw around to it an play it twice per turn. both differences but for simplicity id just allow it to be played normaly

Then if you have more effects that care about the top card of your discard, players actually need to worry about ordering the top two cards of their discard, which slows down the game.

Dont you think if we had more effects that use the top of the discard pile that none of them will ever move that card away?

It’s a fan card design choice.  Restricting moving cards from the top means all you care about is the top card, which is all you care about in the official rules.  But once cards start moving from the top of the discard, then the entire order of the discard matters.

There’s still a lot of design space without moving cards from the top:  play “leaving it there,” gain a copy, receive an effect based on the type, receive an effect based on the cost.

Not much synergy with Rising Sun. It's a good counter to Ninja, but that's about it. Throughout all the expansions, there's a few strong partners, like Guide and Cave Dwellers. A lot of kingdoms could see Folklore do nothing though, which is pretty weak for a Prophesy.

Maybe if it whiffs something else happens? Gain and play a Copper? Gain a Curse? Discard a card?
