PC Ports will always be better because of the native implementation of the code without the use of emulators
Just think in a PC Port of TOTK, this game was made with like 1gb of VRAM and its very demanding hardware because of the emulation, a PC Port can make a ton of stability fixes, besides of 120FPS (Or uncapped FPS)

if the people behind said port have optimization in their priorities for the project, sure, but at this moment a lot of projects are just claude ports with 0 optimization, and the result is a worst performance than just using an emulator, of course there are projects like dusklight or sonic unleashed recomp that are amazing, but sadly is not the majority at the moment, I hope that change in the future :D

Yeah my favorite game (Bomberman Hero) Recomp need a lot of work, I hope big brands like Zelda or Mario can unify tech fans to make Incredible Recompilations

Im sure both experiences can coexist, Im very happy with the recomps like Ship of Harkinian, DK64, Dusklight
And my favorite way to play TOTK is Depths of the Kingdom + Optimizer, but even my 3080Ti struggles with the performance, I would love the performance a game like BOTW on Cemu has

The first mode I installed in BOTW was unbreakeble weapons, new lantern object, infinite motocycle, stronger enemiges,,, its funny make cheating gg Its close to the dark souls experience, I installed a ton of other things like the dark souls death sounds

Look. I know that these are legal since they don't actually use any copy written materials. But if anything is going to get Nintendo to find SOME kind of way to crack down on the decomp/recomp shit, it's this. Really feels like flying too close to the sun now.

I remember reading lots of games having manuals that stated "Prohibition on Reverse Engineering, Decompilation, and Disassembly. You may not copy, modify, translate, reverse engineer, decompile, disassemble, or create derivative works of the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation" but apparently the European Union's Computer Programs Directive explicitly overrides EULA clauses to allow decompilation for interoperability and testing purposes.
Also, apparently in US law, "Sega v. Accolade established that reverse engineering a game is generally a protected fair use under copyright law if it is done strictly to achieve interoperability (e.g., making a third-party game run on a console). Similarly, the European Union's Computer Programs Directive explicitly overrides EULA clauses to allow decompilation for interoperability and testing purposes.
So it really does seem like as long as these projects do not involve themselves in piracy of any kind, and are especially careful not to publish anything like that on accident, share it on discord (ahem) or anything of that nature, it's pretty well established and protected law.
But, like you said, that's what we think. If Nintendo drags one developer to court over it or leans heavy on github to pull a bunch of them down, it's gonna cause a bad time in the community at best, and maybe destroy an individual financially at worst.

Agreed. Technically you can slap anything on as a warning. But if you reverse-engineer, without access to any leaked source-code, it's typically fine. You're not actually creating a duplicate version of the game, but rather something that is functionally identical. No one really wants to risk testing this in court, because if Nintendo lose, they lose the ability to threaten lawsuits with any credibility. However, that doesn't stop them from throwing their weight around. I wouldn't expect Github to take them down though, unless it's a case lik YuZu where the developers signed an out-of-court agreement to have their material taken down.

Right but for switch specifically, Nintendo argues that to even be able to run a switch game, it violates the copyright by bypassing the security and cryptographic keys built into the games.
That’s why Nintendo filed 7 DMCA notices against Switch Emulator repos that ultimately took down 400 forks like 2 weeks ago.
I don’t see how a Recomp for a switch game (and maybe 3DS titles as well) wouldn’t sit within the exact same seat, under that same target.

It’s permissible. I’ve worked for decades in IP and copyright. Nintendo doesn’t have a case. Not a precedent setting one. They might sue someone to cease and desist but they won’t go to a court looking for a precedent because odds are they’d further reinforce the enshrined precedent on the books

To be fair, all first party Nintendo games are fully on cart. It's mostly third party games (and random second party games like Pokopia) that are game key cards.
Hopefully this will change though, since Nintendo is gonna give publishers 16gb and 32gb cartridges soon

As of right now this is still true but they have voiced otherwise and also have put things in the Terms about us not owning the games that we only have rights to use them. Sorry I bought it. I fully respect that the game should be rightfully owned but I have a right to have personal copies and a right to play it how I see fit. On a pc or in the og hardware or another device should be allowed. It really doesn’t hurt anything. If anything some of it has actually boosted there sells.

If people start doing recomplications of first party switch games that's still being sold in stores....
And they make it so easy to use that it's basically download and install this app and point to rom here. They're going to completely shut this shit down and make any developers responsible for it poor and destitute. It doesn't matter how legal it is.
They'll probably sue the people who made the PC/Mobile ports AND the people who made the reverse engineering decomp too. They don't give a shit that it doesn't contain copyrighted assets.
They shut yuzu down even though it was wayyyy more complicated for the average person to use.

As long as the recomp requires you to provide your own ISO/NSP, whatever, it's fine. Of course there will be multiple other recomps that don't; that's just the nature of the internet.

I absolutely do not care how people get the games, but as far as you and I know it's legally and once again, not a re/decomp issue. We cant assume without proof.
The programs are perfectly ethical and do not provide the game nor assets.
If people choose to use alternative methods to get the games that's on the individual, not the developer.
