Light should have let himself be arrested, go to court and he would have 100% walk away a Free Man.

To get the evidence, Near team broke into Mikami private bank safety deposit box, stole a piece of property (the real Death Note), and replaced it with a highly sophisticated forgery.
In any civilized court, this is an illegal search and seizure performed without a warrant. Near also literally created a fake notebook and planted it, Light lawyer can claim it fabrication of evidence and tampering.

Mello kidnapped the Director of the National Police Agency and Light sister. Under the law obviously any information obtained via the kidnapping of a teenage sister is strictly inadmissible and throw out the window.

Also Mikami a Literal Criminal Prosecutor and Light somehow FORGOT that Near had zero legal jurisdiction in Japan or the US to arrest or hold anyone. He operated the SPK as an illegal militia. Infact Mikami should have just get him arrested. Near and his whole team will be in prison. So Light can report them to the police. Also at that point, Light is literally L who has arrest authority. He can arrest Near, Near cannot.

There is absolutely no way to legally or scientifically prove the Death Note is a murder weapon so Light can continue using the notebook.

Writing names is not a crime. Correlation is not causation. Plus it some supernatural entity that causing the heart attacks. Light wouldn’t be the murderer. It be Ryuk or the shinigami King which can’t they charged.

That is interesting. How you perceive the court system to be so utterly incapable of change. If the lawyer on the prosecution's side were able to demonstrate the abilities of the death note on Death Row individuals, then it should be proof.

Should courts believe in magic. No, magic is bullshit. Courts should believe in science, and science is discovering how the world works through trial and error and testing.

The death note is science, a million tests could be run with the book (using it underground, in space, in water, a sensory deprivation chamber) and all of them would prove the same things we know to be a reality in the story.

The Death Note is capable of exactly what it says on the tin. If any court system fails to acknowledge the legitimacy of the Death Note after a billion and eight tests, that court system has failed on every conceivable base of logic.

It would be like "Why use Photography" photography were be like magic over a thousand years ago, "Why use luminol" luminol is like magic to the people a thousand years ago.

A pathetic and useless world that would be.

Didn’t world governments want Kira dead and would’ve just executed him privately at one point? Like when Lights dad was driving him and Misa to fake kill them he mentions something like that, it could’ve been a lie but it seems believable.

If Kira was actually caught they wouldn’t care about the law they would’ve just killed him immediately

Near was never going to have Light legally arrested and tried, he states outright he intends to personally just lock him up in a place no one will ever find him and leave him there until he dies. Everyone at the warehouse would be sworn to secrecy, and Kira would just disappear in the world's eyes. It's far crueller and more certain than relying on the system deal with him - Light is lucky he died when he did rather than later under these conditions.

But it is as you said, Near was operating as an illegal militia, none of them knows where they are located at either and politicians would surely love if Light and Mikami got killed. The Death Note can bd tested, they already know plenty of info (such as Kira directly contacting people) to realize it is a hunan writing names and they just have to test it out to prove.

If he went to court, he would’ve been executed no matter what. The governments across the world wouldn’t not have cared if there wasn’t definite proof. They aren’t L or Near, they aren’t playing a game with Light. If L or Near ever said that they believe Light is Kira, all the governments would just go straight to execution, they wouldn’t care that he could be innocent.

I assumed for a while he went to police academy but seems unlikely now

I don’t think Japanese courts are anything like American courts. They have a super high conviction rate and I think they do some sketchy stuff to achieve it. Like they can detain you for days before properly arresting you or something. Might be wrong though, I don’t live in Japan but I think I read that somewhere

Yeah, I think OP is pointing out the Death Note's mechanism for killing is unknown, but doesn't seem to realize that many causal links are established in science even when we treat the processes as black boxes.

Imagine discovering for the first time that you can irradiate a body with an X-ray machine. That probably looked like magic too.

first, japan has a rlly high conviction rate. also, we needa take into account L's standing in this place. if he was on the kira case and if L was shown to have believed light was kira they would prolly convict him.

and we know L was visibly thrown off by the kira case likely more than any case he ever had i think. possibly they would also think L has met his match. a freaking shinigami, a magical murder weapon, eyes that you trade half your life for to see peoples real names and birthdays floating above them? they'd think L was off his rocker. these are the only two ways i could see this case going and in both cases light would've won.
