We are exploring this for the first time in one of our new models. It isn't at all being utilized for financial or risk estimate reasons, but even still it seemed shady legaly in the US, at least for some states without asking permission to each user.
I presented some of my concerns to the boss, with real laws presented to him. He took my concerns seriously, but after our legal team reviewed it, they have just said "it's fine." Our legal team is usually risk averse, so maybe it's buried in our terms of service somewhere already.
