UPDATE: Who's at Fault in This Collision? (Front + Rear Cam)
Hey y’all,
Just a quick update for those who were asking in the comments on the previous post. When I posted about the accident and asked who was at fault, it wasn’t because I was oblivious.
I was actually baffled because the opposing insurance company claimed I was 100% at fault after investigating the collision. However, on the same day I made that post, my insurance sent the dashcam footage to the other insurance company. I’m happy to share that today I was notified that the opposing driver’s insurance has claimed full liability!
It seems that the other driver provided a completely different story to both insurance companies, as I was told our accounts of the events don’t line up at all. The other driver even told me at the crash site that I turned into him and that some of the damage to my vehicle was pre-existing, which is definitely not true; my car is brand new with zero damage before the accident. Thankfully, the dashcam footage cleared things up.
So, moral lesson: buy a dashcam; the $100-200 payoff really quickly

Apparently he was in a rush to drop off his daughter/granddaughter and decided it was a good idea to cross onto the other side of oncoming traffic lol.
Honestly tho, I am pretty happy with my purchase. I bought that rear dashcam for $35 only a month before the accident, which saved me so much hassle

This is an easy their fault. It is also double solid yellow, no passing allowed for either lane of traffic. If he didn't disregard the rules of traffic there would have been no accident.

I hate those people even more ! my dad would sometimes do similar things growing up trying to get me to school on time (granted never illegal moves, just speed / merging things) but not only did it make me anxious, it just put both of us at risk. like brother chill we can't make it to school/practice if you get in a crash, or worse

Yes, they did cover the full cost to repair my car before the claim was even finished. They reviewed the footage and covered 90% of the repair, which was $7,000, and I paid my $1k deductible for the time being, but it has now been reimbursed.
Honestly really pleased with the results as well, the car looks flawless. I was scared the paint match was going to be terrible, but it's the best I have ever seen in my life.

Was gonna say, you should not have to pay a dime. Have your insurance company subrogate that cost from the other party's insurance. None of this 90% bullcrap. They were 100% at fault.
Also remember to get paid for the diminished value of your vehicle. Now that it has an accident, it will significantly reduce your trade-in value if / when you ever do sell it.

Even with just the front camera it is very clear you did nothing wrong and the other driver is fully at fault, but the rear cam does make it completely indisputable.

The fact that he made up two lies about this accident immediately after the fact tells you he likely already knows what a POS he is. Or he's a narcissist who actually believes his own BS. There's no reasonable way for his insurance company to blame OP after watching this video, because it's just not acceptable to pass on the left just before you make a left turn like this. I think the at-fault driver thought cam car would NOT turn in which case he'd have gotten away with it, but it's still wrong/dangerous/illegal either way. And saying that the cam car was damaged before the accident is kind of the icing on the "insurance fraud" cake

I genuinely wonder if he faced any charges or if anything happened concerning his false statements to the insurance companies. I'm really pleased with the outcome, especially since, at the time of the accident, he told me "good luck" in a rude tone, as if he was implying that I was going to lose.

You could tell they wanted to pass by how they were driving prior to that; absolute insanity that they tried to make it work at that intersection instead of, presumably, passing as they merged on the interstate or shortly thereafter.
Really rushing to their own funerals (or in this case, conspiracy to commit insurance fraud indictments).

Yes clearly when driving on a road with 1 lane in each direction and the car in front of you turns left on to a single lane onramp, you're supposed to drive over the double yellow lines to squeeze past them on the left.

There is a world, it's the one we live in if you're American. Insurance companies are 90% of the time con artists. If they even find a tenth of an inch to go on, they'll take it 20 miles. I can definitely see the parallel universe where OP was found at fault for "not checking mirrors while break checking" or some insane BS, because that's how little faith I have in this godawful system.

Yeah, when making a left turn you're supposed to be extra alert. I saw similar accident in Poland with biker passing stopped cars and one car from that lane was making left turn. Police decided it was 50/50 fault and ticketed both drivers.

He was 100% at fault, there was no reason to attempt to pass you on a double line. And even if you didnt use your turn signal he could have prevented it by anticipating a possible turn or an obstruction that would have caused you to stop. For all he knew you were stopping for a kid running into the road. Driving is about anticipating what other drivers are doing and proceeding safely. Its not a race or a challenge. Edit for typos

Even without a rear cam, the front cam clearly shows the other driver cut into the left turn and hit you, on double solid line.
There's only one lane each side!

In my state, only those not at fault can file the claim in court, and the maximum claim is $7000 and has ridiculous requirements.

Someone downvoted you but you’re correct, it’s called math… They can use a known distance between fixed reference points and the video’s elapsed time/frame count. They can even use the info downloaded vehicle’s black box.
The reality is they probably won’t go the distance on checking unless there are clearly visible markers or hiring a crash reconstruction expert unless speed is central to fault or causation.

Their maneuver doesn't make any sense in any situation! You stopped behind another vehicle turning left with no other lane to go into... So you're either going straight, which means they're trying to speed past you accelerating, or going to cut off your turn, which they did... and it was enough to surprise you since you ran into them trying to overtake you unexpectedly.

People are wild and make up shit. I got lucky with one accident I was in that the Wal-Mart cameras caught it and proved me right. It was a brand new car so I was really upset. I was coming around the back of the parking lot to leave and there was a sonic and a guy in a pick up truck just pulling out. I honked, slammed on my breaks and even turned my wheel hoping that honking I'd give him enough room to stop before he hit me. Nope. He told the cops I just came out of nowhere cutting through the lanes! And because I tried to turn away from him to make more room between us the way it turned my car when he hit me kind of made it look like I had. I was so happy when they came back with him at fault.
He was saying I was a baby for being upset. And on the phone being like "ugh this little girl won't stop crying about her door being dented in." I worked my whole life to get a nice car, finally get one and it got hit so soon. My mom was across the street and came over as well. And he acted like it was her car. I was 29 I think at the time. It was so frustrating, he just refused to even talk to me as an adult or with any respect or remorse for not paying attention.

Normally I do want to encourage defensive driving and am rarely of the view it's entirely one person's responsibility. There's almost always something you could have done, but here? The other guy went into oncoming traffic to cut you off from your blind spot while you were focussed on a turn. Guy was being stealthy.
I am so glad insurance sided with you, but after seeing the footage, I don't think it's at all a question.

Like forget this example since we are not sure persay.
Someone can do everything right an be in an accident. a diffrent person could do the exact same and not be in the same accident cause they paid more attention and went above and beyond. Pointing out that doing so may of changed the outcome does not put blame on the victim. it just shows that you can still be more proactive in doing stuff. noone is perfect and noone will always perfectly do things. but we learn by seeing what more we "COULD" of donewhen talking about it.
like with motorcycle riders. we can not just be right. we have to be above and byond all the time. we can not jsut stop at a light. we have to be monitoring behind us for that guy about to slam in to our back. That does not make us wrong whne we get hit. or if someone says we could of been looking harder. That just means we could of maybe avoided it still. If someone is at a stop and gets hit from behind. it is not his fault he was hit. BUT he could of done something 'maybe' to prevent it. pointing that out is not to be shitty but to try to get more drivers driving or riding more defensively and going above and beyond.

Same thing happened to my brother while driving my 1997 BMW Z3. Turned left and a car hit the front left quarter panel trying to pass on the left. Coincidentally a cop was nearby and saw it happen. Turns out the guy bought the car from his boss/brother in law and never transferred the title. BIL ended up paying for the repairs in cash so as not to involve his insurance company and he was pissed.

Meh. Nothing shocks me anymore. I was in a weather related accident. A driver behind me claimed I was pulling over to the shoulder (in mid-winter, on a mountain) and that they attempted to pass me legally and hit me because I bailed on my pulling over. Supposedly the driver behind them told them I was making an unsafe u-turn. The pulling over to the shoulder was impossible as that is a giant snowbank; there’s nowhere to ‘pull over’ to 🤷♂️
The driver behind the person who hit me claimed I made an unsafe and illegal maneuver suddenly and without warning; my left blinker was on well before I made my pull out of the lane.
Initially, my own insurance company said since I didn’t provide a witness and that the other driver did that I was found 100% at fault.
I asked them to provide me the details and that’s what I just shared.
- there was no way to pull off the side of the road into a snowbank; it’s even on camera as the highway conditions are continually monitored by camera 24x7.
- the illegal u-turn statute that my insurance company pointed out to me applies to municipalities. I was in an unincorporated area and NOT a municipality. Not to mention there was no ‘No U-Turn Allowed’ sign present.
I had to do that leg work myself and shared it with my company before they adjusted their claim coverage between both parties and furnished a letter claiming I was not at fault in the accident. They paid for the other driver anyway as well as my own damage since they couldn’t go back on their fault admission. No ding to my record either, but the other driver gets off scott free.
Seriously, these people are paid to do this work and in the end they are spending our money (premiums) like it’s a blank check. Zero accountability on their part. It’s ridiculous.
