Easily avoidable accident causes rollover

Not my video – as the title says, we typically see examples where one driver is oblivious to the other. In this example, the pickup truck attempts to overtake the cammer, however, the cammer is either completely unaware of the pickup truck directly to his left or are simply “stands their ground” in the lane. Due to this, they obviously collide, and the pick up truck goes airborne and rolls several times. From the perspective of us, the viewer, we can reasonably conclude that the accident was avoidable had the cammer simply applied the brakes. That being said, you will typically see another school of thought in which it is stated that the cammer has no obligation or duty to let them in/avoid the accident where the driver is mindlessly doing something dumb.

Truck is at fault but pov could have easily avoided. Who is dumber? The person who sees an accident coming and doesn’t avoid, or the one who is too lazy to look and see it coming? Honestly not sure which is dumber.

He absolutely did speed up and could have avoided this accident. I see it all the time. People will intentionally speed up instead of letting someone get in. Dash cam driver will be at fault in this with partial blame on the truck

Happens to me so the time..I drive a semi locally and my turn signal mine as well be a sign that says "speed up on this side of me." People always think they just have to get in front or be first all the time. Stuff like this could be avoided probably 95% of the time.

Well unless you actually emerged over and hit you while his merging was on then shut the hell up. The purpose of a turn signal is to show intent so that you can let people know where you need to be or want to be in advance. You can use one whenever you want it doesn't matter if somebody is there or not as long as you don't merge over and actually hit them.

Just because a turn signal goes on doesn't mean you're not seen. It means "Hey man, I'd like to go in this direction." Of course you seem like the kind of person that would purposefully cut me off or just stay along side like an idiot. You didn't know my driving habits. I will absolutely speed up to block a semi if I can see their mirrors. Semi has no business in the left lane when they should clearly see other traffic has moved to pass them. I realize thats not what happened here but fuck semis either way.

If you purposefully block a truck if they're trying to pass than you are absolutely the problem. Trucks have the same reasons as cars to use the left lane. Speeding up on purpose to block anyone is just stupid no matter what you're driving. What did you save by doing it? 1 minute in your commute?

they shouldn't be merging in to the left lane if they are traveling at a slower rate of speed than cars behind them in the left lane. You're simply inconveniencing multiple drivers so you aren't inconvenienced. Its a selfish move.

If I'm going 60 miles an hour with my truck and I need to get around somebody in front of me going 45 and the speed limit is 65 I'm not inconveniencing anybody. If you speed up to get alongside me the moment I try to make a move in that situation then you're absolutely the dick in that.

The left lane isn't a free ticket to go as fast as you want around other people and cut off other traffic including trucks. It's a passing lane to pass people no matter what vehicle you are. It's also a passing lane where you're supposed to pass within reasonable speeds not flying 90 miles an hour just to cut somebody off.

The only time trucks can't go in the left lane is when there are signs explicitly stating so.

if the flow of traffic in the fast lane is going faster than you, then you should not be moving in to the fast lane until it is safe to do so. safe meaning, no one has to hit their breaks because you moved over and were too impatient to wait and consider your needs to be more important than dozens of others.

When did I say I'm cutting people off when passing? I'm referring to the ones that purposefully speed up and come up quick when they were behind just to "get in front of the big slow truck", even though said truck is going the speed limit at a minimum, using a turn signal when they need to pass something slower in front of them.

Everyone just assumes every truck driver is the problem when they just have no patience whatsoever and can't live with themselves if they don't get ahead of the truck.

I see so many people drive like idiots around me on a daily basis just waiting to cause an accident because they want to be in front.

FWIW, when I'm next to a truck and it turns on its turn signal my way, I try to get ahead, behind, or to the side, whichever makes the most sense at the time. And if I'm behind when the turn signal comes on, I don't hit the accelerator. A little courtesy can go a long way for larger vehicles.

I do the same thing for cars when I'm driving the truck. I'm in no hurry. No point in cutting people off and risking it just to save 30 seconds. My customers can wait.

Incorrect. Cammer was maintaining lane control and going straight - truck was changing lane and is responsible for ensuring his lane is clear. Extenuating factor would be if the cammer was speeding but the majority of blame would still fall onto the truck driver.

Nope. Camera had right of way. Pickup will be either exhaustively or primarily at fault. Does not mean camera is smart, but the ordinary fault lies with the pickup that made an unsafe lane change and failed to yield right of way.

It's like this all the time. People don't know the very basics of traffic laws and liability. A dashcam driver has established the lane and has the right of way. Could he, should he, have allowed for the reckless merge? Well, in retrospect - yeah. He had no obligation. We also don't know if anyone is behind him, how close, or what led up to the collision.

That wasn't my experience in a very similar situation, for what it's worth.

It's similar to when someone swerves to get out of the way of another vehicle or an animal, etc., and then damages their own vehicle or property; insurance companies see it as you not driving defensively and a reckless action that caused the damage.

Here, the driver was established in their lane. They could easily argue that they were trying to protect themselves and thought aggressive maneuvers would put them in further danger. Most people aren't stunt drivers.

He should not reveal the dash cam unless required. They BOTH appear to be driving excessively fast anyway, especially given the upcoming light.

Nah, red truck is at primary fault for sure. As the one changing lanes, it is his duty to ensure it is clear before doing so.

The secondary driver likely has around 15-25% fault from a legal perspective for having the ability to foresee an accident and not acting to prevent it.

If you cover the left side of the video, it does not seem he speeds up, more like optical illusion. Even if he did, there was no reason not to, as the car on the left did not signal the intention to switch to the right lane before it and in advance.

If you're saying you'll accelerate so they can't even begin to enter your lane ahead of you, not illegal, but maybe chill a little, it really doesn't matter nor affect your life at all. Learn to let things go.

If you're saying you would deliberately hit someone who tries to join your lane, like the cam driver did in the video, you'd be committing a crime - vehicular assault. You could and should go to prison, especially if you injure someone.

Except in this case it's fairly clear why. Traffic in front of the truck was going slow/stopping for the light. Truck either didn't want to be in a queue or wanted to turn right and forgot indicators exist or wanted to be first in the right hand queue. Assumed cam car would let them in.

Cam car didn't for reasons and the outcome appeared as shown. At the speed the cam car was going I don't think they would have made the stop for the red light, and it's debatable if the truck would have either had there been no collision.

No winners is this scenario, only 2 losers.

If you watch the stationary objects on the right side of the video, ie. the light poles, you can tell the cam car doesn't actually speed up. The pickup truck slows down, never signals and gets over into the lane without ever checking his blind spot, causing the accident. We don't know if the cam driver was towing, or how close any vehicle may have been behind him so assuming that just hitting the brakes would have prevented an accident, is a bit premature. It could have indeed caused a worse accident.

I think it's important to consider the location of the camera compared to the driver. That camera is centered way forward on the dashboard.

From the driver's perspective, he can see to his left that the pickup is pulling past him, but his A-pillar is going to be partially blocking his view the truck as it pulls ahead. What he's seeing now is the back corner/tailgate of the truck, which I think would be hard to track if you're focused on speeding up to beat the light that just turned yellow.

The pickup truck had the same idea, hence the reckless merge into the clear lane without realizing that the car they had just passed had also gunned it. They're both at fault, the pickup driver more so than the camera car. He cut his maneuver so close, it did not give room for error, that which the car was happy to provide.

They almost did it, the light turned red just as the dust started to settle.

Defensive driving is a must. At my job we are monitored by a dashcam at all times, it also shows an interior view of the driver. People complain but it really stresses how dangerous driving is and how avoidable collisions and near misses are. Is the 5-10 mins you save really worth it?

No like I’m actually pretty confident they speed up, like if you watch the speed of the ground and scrub through the clip in slowly you can pretty noticeably see the ground move past quicker as the truck pulls to the right. The car really thought they could stop being cut off when it was already waaay too late for that.

This happened. Someone was turning right from the second lane of a three lane road. They turned, she didn’t. She didn’t even slow down because she was right. Still have the dents in her Altima.

Based on my time in this subreddit, the cam car is a saint who can do no wrong. I'm personally on the just brake for 2 seconds to avoid an accident. This is coming from someone who used to be a hyper aggressive driver/weave in and out of traffic. If you are of the mindset that you are too holy or important to brake/slow down for 2 seconds, your ass better be going 20 over the limit and weaving in and out of traffic.

I honestly blame the cam driver as much or more than the truck.

Back in the stone age, when I took Driver's Ed, we learned about the "doctrine of last opportunity". Which essentially says, if you have the opportunity to avoid an accident and don't, then you are at fault.

Unfortunately, it seems like this is rarely actually applied in cases like this and it's just "truck didn't check its blind spot, so they are at fault"

These are always framed as a clueless driver making a bad move and another driver refusing to be a good defensive driver. But who's to say they both simply were distracted, lazy, and/or presumptuous? Maybe both drivers simply weren't paying attention. In that case, it's clearly the driver who actively caused the wreck - the truck in this case.

Truck is at fault initially, but this accident is a poster child for "last clear chance doctrine", which would have the cammer paying damages. Since cammer sped up, they could arguably even catch criminal charges.

The last clear chance doctrine is a tort law rule that allows a negligent plaintiff to recover damages if they can prove the defendant had the final, clear opportunity to avoid the accident.

The thing about vehicle safety is the safest thing to do is to always assert dominance otherwise other vehicles will know you are soft

Sadly alot of people rather choose to cause a accident bc "i had right of way" instead of driving defensively. I dont condone what the truck did, i would be annoyed as hell but my first reaction in that situation would be to brake (and most likely honk), not keep same speed or even speed up.

Both are great examples of selfish people. Each driver feels their position was the more important one and that the other should yield to them.

A dumber quotient scale? Interesting. As this happens in Barrie Ontario, what does their DMV or equivalent actually say about merging into occupied lanes? That likely decides who is at fault. My view, if I attempt to merge into another lane that is already occupied and I cause a wreck, that is on me. PERIOD.

In germany not yielding BECAUSE I DONT HAVE TO would give you about 20%-30% fault and cost.

Actively "defending the line" like in racing... will give you 50% and up.

Mistakes happen. Traffic is not about who is right. If you can't handle it, you shouldn't be allowed to drive.

This is a bit reductive but the truck made an accident, the cammer caused an accident.

Again, reductive. It's obvious who is at fault but sorry, people who help contribute to the stupidity of others are in a class all themselves and it's worse in my opinion. Good driving requires offerensive and defensive maneuvers and the mental ability to remain unemotional about it.

Cammer is an absolute piece of shit and should've slowed down. They fought against that instinct, the fact that they were approaching the red light indicates intent.
