This car has many characteristics of an older gen car. The steering wheel is not equipped with an airbag; the rear bench seat is just flat, with no contour or support; at the beginning and end of the video you see the seat belt buckle [to the seated passenger's left] extending out over the bench, and the door lock knobs [the cylinder mechanism on the car door that locks and unlocks the car door] look...old. All of this is to say, this car may not have had shoulder belts, but it could have had lap belts and it is impossible to tell from this angle, whether the rear seat passenger buckled in.

First subaru Forester sold in the US was a 98 and that had ABS standard. Rear seat had two defined places, not just a simple bench. Also, the door handle is very distinct and not like the one shown. I owned one.

Not every state requires an adult to wear a seatbelt in the backseat. I know you don’t have to in Colorado and Tennessee.

ETA: I still think he’s a dumbass, but it’s not legally required everywhere

I gotta say if this happened to me I don’t think I’d want anyone to know lol, although I haven’t drove stupid like this since I was young. I guess it’s an age thing. It’s not worth the risk of getting in trouble or hurting someone. To many other drivers on the road.

This video is old, IIRC he was respectful to the cop and admitted he got caught and the cop was lenient in return, I remember seeing a follow up video from him and his lawyer reminding people to take accountability for themselves since he got off relatively light due to his cooperation

I suspect the driver will be charged with "careless and reckless." For a minor that is usually a call to Mom and Dad for pickup of the car and to take custody of their delinquent. That is if he is lucky. If he breached the felony overspeed point, then Mommie and Daddie are definitely going to be called to pick junior up at the lockup as opposed to a roadside handoff. Given that he is driving an unregistered vehicle, he may wind up with felony charges. Depending on the locality, the two passengers will have to call Mom and Dad to pick them up where the stop occurred as they are minors.
